This article shall be known and may be cited as the "Animal
Control Ordinance."
As used in this article, the following terms shall have the
meanings indicated:
Any animal owned, maintained, controlled or kept by any person
for pleasure, including, but not limited to: dogs, cats, pigs, horses,
birds and rabbits, which does not include any animal kept or raised
for agricultural purposes.
The provisions of prior ordinances or resolutions, or parts
thereof, that are inconsistent with this article are repealed in whole
or in part to the extent of any and all such inconsistencies. The
following ordinance is hereby repealed in its entirety: Ordinance
No. 67-1988.
No person having control or custody of any domestic or nondomestic
animal shall allow or permit such animal to make loud, harsh noises
to the extent that it shall disturb or interfere with the peace, quiet,
rest or sleep of other persons. No person having the control or custody
of any dog or other domesticated animal shall allow or permit such
animal to make loud, harsh noises continually and/or incessantly for
a period of 10 minutes or intermittently for 1/2 hour or more to the
extent that it shall disturb or interfere with the peace, quiet, rest
or sleep of another person.
No person having the control or custody of any domestic animal
shall allow or permit such animal to befoul, defile or corrupt any
public property, street, road, driveway, sidewalk or walkway, or property
of another person.
No person having control or custody of a domestic animal shall
suffer or permit such animal to run at large in the Township of Carroll
and upon public streets or highways or upon lands of another other
than the person having the control or custody of the animal.
This article shall not be deemed to prohibit, or otherwise declare
unlawful, any agricultural operations protected from nuisance suits
by Act No. 1982-133.[1]

Any person who violates or permits a violation of this article
shall, upon conviction in a summary proceeding brought before a Magisterial
District Judge under the Pennsylvania Rules of Criminal Procedure,
be guilty of a summary offense and shall be punishable by a fine of
not more than $1,000, plus costs of prosecution. In default of payment
thereof, the defendant may be sentenced to imprisonment for a term
not exceeding 90 days. Each day or portion thereof that such violation
continues or is permitted to continue shall constitute a separate
offense, and each section of this article that is violated shall also
constitute a separate offense.
This article shall become effective October 13, 1997.
