City of Utica, NY Chapter 2-31 Complete Streets

Sec. 2-31-1 Incorporation of concepts, features and practices.

The City of Utica Engineering Department shall incorporate complete streets concepts, design features and practices, to the extent appropriate and feasible, in the planning, design, budgeting and implementation of local highway, street and sidewalk improvement projects undertaken by the Department.

Sec. 2-31-2 Context sensitivity.

The addition of complete streets facilities shall be consistent with the scope of the construction or improvement project, sensitive to the surrounding environment, and shall not be disproportionate with the cost of the larger project.

Sec. 2-31-3 Guidelines.

Complete streets facilities shall be planned, designed, developed, and maintained in accordance with bicycle and pedestrian facility guidelines adopted by the United States Federal Highway Administration, New York State Department of Transportation, the American Association of State Highway and Transportation Officials, and other guidelines approved by the Utica City Council.

Sec. 2-31-4 Inability to include bicycle or pedestrian facilities to be documented.

If the City of Utica Engineering Department determines that the inclusion of bicycle or pedestrian facilities are unable to be accommodated on a roadway or within the City of Utica right-of -way proposed for construction or improvement, the Engineer of the Engineering Department shall provide said determination in writing, with supporting documentation, to the Utica City Council for its information.

Sec. 2-31-5 Revisions to other plans and policies.

The City of Utica will incorporate complete street principles into its Comprehensive Plan, Zoning Code, and other plans, manuals, rules, regulations and programs.

Sec. 2-31-6 Funding for implementation.

The City of Utica shall actively seek sources of appropriate funding for complete streets facilities to implement this policy, including federal transportation funds, state grants, Consolidated Local Street and Highway Improvement Program (CHIPS) funds, and local funds.

Sec. 2-31-7 Policy set forth.

Annexed hereto and made part hereof is the Complete Streets Policy.[1]

Sec. 2-31-8 Exemptions.

Notwithstanding the complete streets policies and principles cited herein, no bike lanes or buffer lanes shall exist on Genesee Street from Oriskany Street to Cornelia Place, the solid white line shall be removed eliminating the five-foot line on either side of Genesee Street from Oriskany Street to Cornelia Place, and from Oriskany Street to the New Hartford Town line there shall be no bike lanes or buffer lanes.
