A. 
Fireworks Regulations.
1. 
It shall be unlawful for any person within the City of Ozark, Missouri to discharge or cause to be discharged, ignited, fired or otherwise set in action within the City limits, any fireworks as defined in Section 320.106, RSMo., except on July fourth (4th) between the hours of 9:00 A.M. and the immediately following Midnight; and December thirty-first (31st) from 10:00 P.M. to January first (1st) at 1:00 A.M. and by permit as provided in Subsection (B) of this Section. No such discharge shall be permitted as set forth above if the Ozark Fire Protection District has issued a "burn ban" during said periods.

Fireworks may be sold within the City limits only in tents or other temporary structures located in any commercial, industrial or office warehousing district so long as the prospective applicant meets the required conditions for a permit issued by the Ozark Fire Protection District.
a. 
To obtain the City of Ozark business registration, all applicants must submit their approved Ozark Fire Protection District permit, Missouri retail sales license, Missouri Division of Fire Safety Fireworks permit, and certificate of liability insurance with City of Ozark listed as additional insured.
b. 
Hours of operation for any fireworks sales locations shall be June 20 through July 4, 8:00 A.M. to 10:00 P.M.; December 20 through January 1 of the next succeeding year from 8:00 A.M. to 10:00 P.M.
B. 
Permits For Public Display. The Department of Planning and Development of the City of Ozark shall have the authority to grant an application for public or private fireworks display provided that any person, firm, business entity or corporation makes application pursuant to Chapter 640 of this Code and, further, obtain a permit for such display from the Ozark Fire Protection District.
C. 
Seizures. The Chief of Police shall seize, take, remove or cause to be removed, at the expense of the owner, all stocks of fireworks offered or exposed for sale, stored or held in violation of this Section.
D. 
Any person discharging or causing discharge, igniting, firing, or otherwise setting in action fireworks, shall be responsible for the cleanup and proper removal of all debris and litter produced by their display. Nothing in this Section shall require the trespass onto private property but shall require an attempt to contact the owner of said property to offer cleanup and removal.
E. 
Any person violating any of the provisions of the laws set forth in this Section shall, upon conviction thereof, be punished as provided by Section 100.220.
