Except as authorized by this Code, it shall be unlawful for any person to store or cause to be stored any building/construction material, unlicensed construction vehicles, construction trailers, equipment, tools, storage containers, dumpsters or refuse containers, donation bins or other material of any kind or character upon any street or sidewalk within the Township.
Nothing in this article shall be construed to interfere with the grading and repair of sidewalks or streets, installation of public utilities or the placing of material for such purpose or as otherwise approved by the Department of Code Enforcement.
In any case where the owner, occupant or tenant, contractor, business or corporation as aforesaid, shall fail, neglect or refuse to comply with any of the provisions of this article, such material, equipment or containers may be removed by the Township Public Works Department and shall be placed upon the property upon which such material is to be used, outside the limits of the street and sidewalk. Any expenses incurred by the Township in removing the material, with any additional amount allowed by law, shall be collected from such owner, occupant, tenant, contractor, business or corporation as the case may be, which may be in addition to any fine or penalty imposed under § 261-42 of this article.
Any person, firm or corporation who shall violate any provision of this article shall, upon conviction thereof, be sentenced to pay a fine of not more than $600 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this article continues shall constitute a separate offense.
