Where any Borough road, including the paved area, gutters, utilities and right-of-way, is damaged in any manner whatsoever, the person or persons directly responsible for the damage, the subcontractor and/or general contractor for whom the person or his superiors work, or with whom they have contracted, shall be jointly liable for such damage and be held responsible to repair the damage within 90 days of any written demand by the Borough. All repairs shall meet Borough standards and shall be subject to Borough inspection. The liability of the developer, if any, shall be determined by the Road Committee of the Borough Council with consultation of the Borough Engineer and/or Superintendent of Public Works, Borough Manager, and the Solicitor.
A. 
All residents are responsible for any gravel or aggregate/debris/silt/dirt that migrates onto a public roadway from their private property by runoff, plowing, maintenance, construction, or any other direct or indirect means. The aggregate must be properly removed from the public roadway within 10 days of a written notice from the Borough. If not removed from public roadway after 10 days, a second notice will be issued notifying the resident that the Borough will clean the aggregate at the homeowner's cost. The Borough is not responsible for any damage to the driveway during clean up, nor is the Borough responsible for replacing any aggregate on the private property.
B. 
If the Borough cleans the aggregate, a bill for the work will be sent to the property owner and, if not paid in 30 days, a municipal lien will be filed on the property.
