Any violation of these Regulations or any violation of any terms
or conditions of any action imposed by the Planning Board or of any
other agency or officer charged in these Regulations with enforcement
of any of the provisions shall be subject to the provisions of this
Article.
Violation of these Regulations includes any action related to
the transfer or sale of land in unapproved subdivisions. Any owner,
or agent of the owner, who transfers, sells or negotiates to sell
any land by reference to or exhibition of, or by other use, a plat
of the subdivision before the plat has been approved by the Planning
Board and recorded in the municipal land evidence records, shall be
in violation of these Regulations and subject to the penalties described
herein.
The Town may also cause suit to be brought in the supreme or
superior court, or any municipal court, including a municipal housing
court having jurisdiction, in the name of the Town, to restrain the
violation of, or to compel compliance with, the provisions of this
zoning ordinance. The Town may consolidate an action for injunctive
relief and/or fines under these Regulations in the superior court.
1. It shall be the duty of the Town Solicitor, on authorization by the
Town Council wherever a violation or a contemplated violation of these
Regulations is brought to its attention, to institute due legal proceedings
to compel compliance with said Regulations and to restrain the erection,
alteration or use of any building, structure or other thing erected
or used in violation of the provisions of these Regulations.
Any person, firm or corporation employed by an applicant or
developer, who shall violate or assist in the violation or fail to
comply with the requirements of any provision of these Regulations,
or for a violation of any terms or conditions of any action imposed
by the Planning Board or of any other agency or officer charged in
these Regulations with enforcement of any of its provisions, upon
conviction thereof shall be punishable by a fine of not more than
five hundred dollars ($500) for each offense and each day of the existence
of any such violation shall be deemed a separate offense, all such
fines shall inure to the benefit of the Town.
