1. 
Unless otherwise provided, all of the following lands, which include streams, creeks, ponds, lakes, and other bodies of water and watercourses, which are within the jurisdiction of the Township of Lower Macungie are subject to this Part, and are referred to herein as "lands subject to this Part":
A. 
Public Lands. Any and all streets, roads, street and utility rights-of-way and easements, alleys, common thoroughfares, sidewalks, passageways, bypaths, play areas, parks, ballfields, places where people congregate or walk, and any other public lands whatsoever.
B. 
Private Lands. All privately-owned lands, except:
(1) 
Any lands owned by the person who is the owner, custodian, keeper, or person in possession of the animal involved.
(2) 
Any lands for which permission has been received from the owner, occupant, tenant, or other authorized person who is in charge, has custody, or is in possession of those lands.

It shall be unlawful for any owner, custodian, keeper, or person in possession of any animal to allow that animal to run at large at any time, unless accompanied by and under the immediate hand control, by means of a leash, of such owner, custodian, keeper, or person in possession of such animal.

No person owning, harboring, keeping, with custody, in possession, or in charge of any animal shall cause, suffer or allow such animal to soil, defile, defecate, or commit any nuisance upon the lands subject to this Part.

Any person owning, keeping, with custody, in possession, or in charge of or accompanying any animal which is upon any lands subject to this Part is at all times required to be in possession of proper implements for the gathering and sanitary disposal of animal feces.

In the event that any animal has defecated upon any of the lands subject to this Part, the owner, custodian, keeper, person in possession, in charge of, or accompanying that animal shall immediately remove all feces deposited by the animal by any sanitary method. Provided, that compliance with this section shall not operate as a defense or mitigation of any other violation of this Part.

Every person who is the owner, keeper, custodian, or in possession of any animal on any privately owned lands shall cause all feces from that animal to be collected at least twice a week, and then disposed by any accepted sanitary method, in such a manner as not to permit the presence of fly larvae.

Any person, firm or corporation who shall violate any provision of this Part, upon conviction thereof, shall be sentenced to pay a fine of not more than $1,000 plus costs. Each day that a violation of this Part continues or each section of this Part which shall be found to have been violated shall constitute a separate offense.

All persons are authorized to commence private civil actions under this Part by filing a "trespass and assumpsit" complaint, or other appropriate form of action, with the magisterial district judge or any other court of competent jurisdiction.

1. 
To ensure safety and enjoyment for all, park users must strictly observe the following rules and regulations. Those found in violation will lose dog park privileges without a refund of their application fee.
A. 
Dog park hours: open dawn to dusk.
B. 
The dog park is for dogs, their handlers, and those accompanying them. No other use of the dog park is permitted. All users must be registered members with Lower Macungie Township to receive an access key fob to utilize the dog park. Key fobs are nontransferable and can only be used by registered individuals and their dog(s).
C. 
Use of the dog park is at your own risk. Each owner is solely responsible for their and their dog's actions and assumes all liability for damages suffered by any person or dog injured by the member or the member's dog(s) while utilizing the dog park.
D. 
No smoking, alcoholic beverages, food, or glass containers are permitted in the dog park.
E. 
Members are prohibited from bringing dog food and treats into the dog park.
F. 
Children under the age of 14 must be accompanied and supervised by an adult.
G. 
Dogs are to remain leashed outside of the dog park, as well as when entering and exiting the dog park. Members must keep the leash in their possession at all times while using the dog park.
H. 
The dog park is divided into separate fenced-in areas. Dogs weighing less than 30 pounds must use the small dog area. Dogs weighing over 30 pounds must use the large dog area.
I. 
Dogs less than four months of age, unneutered male dogs, female dogs in season, and aggressive dogs are not permitted in the dog park.
J. 
Members are required to clean up after their dog(s). All waste must be bagged and disposed of properly in the marked receptacles.
K. 
Members must accompany and monitor their dog(s), who must be in view of and under voice command of their handlers at all times.
L. 
Members must leash their dog(s) and exit the dog park if their dog(s) is/are acting aggressively towards people or other dogs.
M. 
No more than two dogs per member are permitted at one time.
N. 
Members are responsible to ensure their dog(s) do not dig holes or cause other damage to park plants or property.
O. 
All dogs entering the dog park must be up to date on rabies and bordatella vaccines and must wear a collar displaying their rabies tag and dog license as required by Pennsylvania law. Dogs with contagious health conditions are not permitted in the park.
2. 
There will be regular maintenance of the grass and landscaping by the Township. This includes, but is not limited to, mowing, grounds rehabilitation and structural repair/replacement. During those times when structural or ground repairs are made, the park will be closed. Advance notice of dog park closures will be posted on the Township website. During the short intervals of mowing operations within the fenced areas, you are required to leave the enclosed areas until the mowing is completed.
