The purpose of this article is to protect the health, safety and general welfare of the residents of the Town of Woodbury by minimizing the risk of potential pollution of the Town's surface water and groundwaters from leakage of heating fuels.
As used in this article, the following terms shall have the meanings indicated:
HEATING FUEL
Any petroleum product, including waste oil, but excluding liquefied petroleum gas and liquefied natural gas.
STORAGE TANK
Any tank, vault, container, receptacle or similar structure used or designed to be used for the storage, transmission or disposing of heating fuel, liquefied petroleum gas or liquefied natural gas.
A. 
No storage tank shall be installed or replaced until a permit has been issued by the Building Official.
B. 
Storage tanks shall be installed aboveground or in a basement or vault, be fully visible for inspection and be accessible for repair or replacement. All lines delivering heating fuel to the storage tank and all lines delivering fuel from the storage tank shall be fully visible for inspection and fully accessible for repair. All liquefied petroleum gas and liquefied natural gas storage tanks shall be installed in conformance with the provisions of C.G.S. §§ 29-320 and 29-331, as the same may be amended from time to time.
C. 
In the event the Building Official determines that, due to safety reasons or unusual building or building lot circumstances, a heating fuel storage tank cannot be installed in a manner conforming to the provisions of Subsection B of this section, the Building Official may authorize the installation of an underground storage tank. Underground storage tanks shall be of one of the following designs and constructions: 1) double-walled steel; 2) fiberglass-reinforced plastic; or 3) steel coated with a factory-applied corrosion-resistant coating. Underground storage tanks shall be equipped with contact plates under all fill and gauge openings and shall be equipped with cathodic protection and cathodic protection monitoring devices and conform to STIP-3 (Steel Tank Institute) standards. All underground lines servicing underground storage tanks shall be installed in protective sleeves so as to allow failure determination without the need for substantial excavation. Any heating fuel storage tank and its components which have been approved for underground installation by the Building Official must be inspected by the Building Official prior to being covered.
D. 
The design, construction, installation, and maintenance of any storage tank shall comply with the provisions of the regulations concerning the safe storage, use, transportation and transmission of flammable or combustible liquids and liquefied petroleum gas adopted by the State Commissioner of Public Safety pursuant to C.G.S. §§ 29-320 and 29-331, respectively, as the same may be amended from time to time.
E. 
If an underground fuel oil tank is discontinued, it must be removed from the ground within 90 days. When an underground fuel oil tank is removed, a soil sample should be taken from the "grave" of the tank and tested by an approved laboratory for possible contamination. The contractor conducting tank removals shall contact the Woodbury Fire Marshal's office at least 24 hours in advance for an inspection of the removal, to include the tank, tank grave and witness the soil sample collection. A permit from the Woodbury Building Department must be obtained prior to removal. If a tank is found to be leaking, all contaminated soil must be removed by a licensed hazardous materials contractor.

Any person who, by himself or his employee or agent, or as the employee or agent of another, violates any requirement of this article shall be subject to a fine of $200.
Any person aggrieved by any requirement of this article, or any act of the Building Official in enforcing the same, may appeal for relief to the Building Code Board of Appeals.

The provisions of this article shall not supersede any authority the local or state Fire Marshal may have regarding the design, construction, installation and maintenance of storage tanks due to their capacity, use, or location.
