Dallastown Borough hereby approves entering into articles of agreement (hereinafter referred to as "agreement") to form the York Area Council of Governments (YACOG), marked as final draft dated June 11, 2003, a copy of which is attached hereto and is hereby fully incorporated herein (and which shall be filed with the minutes of the meeting at which this article was enacted), with the intent and effect that Dallastown Borough shall be bound by the agreement.[1]

Dallastown Borough is authorized to enter into the agreement for the purposes contained therein and attached hereto, and the President or Vice President of the Borough Council, acting alone or together with the Secretary or Assistant Secretary, are hereby authorized and directed to execute said agreement on behalf of the Borough, and to execute and deliver any additional instruments, and to take such further actions, as may be necessary or appropriate to carry forth the articles of agreement and the transactions to be effected under the agreement, including payment to the Council of Governments of such amounts as are due by Borough pursuant to the agreement.
As required by the Intergovernmental Cooperation Act,[1] the following matters are hereby set forth:
A. 
The conditions of the agreement are set forth in the articles of agreement attached hereto.
B. 
Dallastown Borough shall participate in the Council of Governments perpetually from the time of formation until such time as the Borough chooses to withdraw by giving 60 days' notice to the General Council of the Council of Governments.
C. 
The purposes and objectives of YACOG are to serve as a forum to identify, discuss, and focus on regional problems and needs, collect information, facilitate cooperative action, maintain liaison with other participating bodies, and other purposes and objectives as are set forth in the articles of agreement.
D. 
The manner and extent of payment for services provided by the articles of agreement are that Dallastown Borough shall pay a proportionate cost of the operation of YACOG in accord with population, user population, or other mutually agreeable method. All funds to pay Dallastown Borough's obligations under the agreement shall come from normal and usual budgeted amounts for such matters, and other provisions governing the manner and extent of the payment for the services shall be as set forth in the articles of agreement.
E. 
YACOG shall be managed by a General Council and officers as set forth in the articles of agreement.
F. 
All property, real or personal, shall be acquired, managed, or disposed of by YACOG in accordance with the articles of agreement.
G. 
YACOG shall be empowered to enter into contracts for policies of group insurance and employee benefits, including social security, for its members.

A. 
Pursuant to the authority of the Intergovernmental Cooperation Act, 53 Pa.C.S.A. §§ 2301 et seq., Dallastown Borough hereby approves entering into a joint purchase and ownership agreement with Red Lion Borough for the lease/purchase and subsequent joint ownership of a street sweeper. A copy of the agreement is attached hereto, and all of the terms and conditions thereof are hereby incorporated herein in full.[1]

B. 
The appropriate Borough officials are hereby authorized and directed to execute said agreement on behalf of Dallastown Borough, and to execute and deliver the lease/purchase agreement with the vendor of the street sweeper and any additional instruments, and to take such further actions, as may be necessary or appropriate, to effectuate the terms and purposes of the agreement, including making payments as are due by Dallastown Borough pursuant to the agreement.
C. 
As required by the Intergovernmental Cooperation Act, the following matters are hereby set forth:
(1) 
The terms and conditions, and the purposes and objectives, of the intermunicipal cooperation are set forth in the agreement attached hereto.[2]

(2) 
Dallastown Borough shall participate in a joint purchase and ownership agreement with Red Lion Borough for the lease/purchase and subsequent joint ownership and operation of a street sweeper.
(3) 
The manner and extent of payment for the purchase are that all funds to pay Dallastown Borough's obligations under the agreement shall come from normal and usual budgeted amounts for such matters, to be funded by general tax revenues, and from fees charged for service to other municipalities.
(4) 
No entity is being created by said agreement which will be empowered to enter into contracts of insurance or otherwise for employees for this intergovernmental cooperation.
