As used in this article.
Shall be held to mean and is hereby described to mean any open air plot of ground, lot or land within the Township where motor vehicles are parked, kept or located for a parking fee or parking charge.

No person shall manage, conduct, operate or carry on the business of an open air parking station for motor vehicles, as defined by this article, without first having obtained a license as hereinafter provided.
The application for the license for the business of managing, conducting or carrying on an open air parking station for motor vehicles shall be made to the Township Clerk, and shall accurately specify the location of the open air parking station, the portion of the lot to be used, and the number of square feet of area to be occupied thereby. The application shall be accompanied by a map or plot plan accurately showing the location of the open air parking station, the area to be used, and the location of the open air parking station in regard to adjacent buildings, public streets and all driveways within 100 feet of all entrances and exits. The map or plot plan shall also show the entrances and exits to be open for use, and individual car parking stall arrangement. Upon the receipt of an application for such license the Clerk shall refer the same to the Township Engineer for investigation and report, and if such report shows that the applicant's lot complies with § 374-4A, B, G, H and I the Clerk shall issue the license; any application for the renewal of an existing license shall, in like manner, be referred to the Township Engineer for investigation and report.

All such open air parking stations for motor vehicles shall be constructed and maintained as set forth in this article.
A.
The surface of each lot or plot of land to be occupied as an open air parking station shall be composed as follows:

The surface of each lot or plot of land to be occupied as an open air parking station shall be so constructed to provide sufficient drainage to prevent an accumulation of water upon the surface of the lot.
C.
No motor vehicle shall be parked, kept or located within 10 feet of any building occupied as a residence.
D.
No licensee shall permit any vehicle to be driven in such a manner that its movement into or out of any designated parking lot shall endanger pedestrians or other traffic on a public street or sidewalk. Nor shall any vehicle parked under any license issued hereunder be parked on any street, sidewalk, or part thereof.
E.
Entrance or exit to any parking lot shall be made only within the set limits of the entrances and exits provided. In all cases these entrances and exits shall be paved, and where operation is one-way only they shall be properly marked with suitable signs of a type approved by the Township Engineer.
F.
No vehicle parked on any such lot shall be permitted to extend nearer than one foot from the street line.
G.
Wherever the boundaries of the licensed area do not contain natural or artificial barriers, in order to prevent damage to adjacent property, such boundaries shall be enclosed by a fence of durable construction, permanently installed, but not less than 30 inches in height. Where natural or artificial barriers exist on the boundaries, bumpers may be installed in lieu of the fencing.
H.
Any parking station open to the public later than one hour after sunset or earlier than one hour before sunrise shall be sufficiently lighted by the licensee while so opened and occupied, so as to provide a minimum of two-tenths lumen per square foot throughout the lot.
I.
All lights shall be shaded in such a manner that no direct rays are visible to adjacent property owners or motorists using the public streets.
J.
The licensee shall keep the licensed premises free from filth, paper and rubbish.
K.
The licensee shall clear all areas of snow or ice within eight hours after snow or ice have fallen. No snow or ice shall be stock piled on the licensed premises so as to diminish the number of parking spaces. No snow, ice, debris or any other matter or material shall be any time be placed upon a public street.
L.
The licensee shall mark off all parking spaces by the painting of while lines upon the pavement by erecting markers which indicate the width of parking spaces. A sign shall be posted notifying the public that parking shall be only in those spaces marked off. The licensee shall issue parking permits or shall allow parking only in those spaces allocated for parking. Licensee shall not issue a greater number of permits than the number of parking spaces marked off.
M.
The licensee shall post signs adequate to notify the public as to the areas restricted against parking by this article.

Licensee shall after notice in writing by the Township Clerk, submit a plat showing all parking spaces, entrance and exits, pedestrian walkways and location of all buildings, structures, fences, walls, and all markers on the licensed premises. The plat plan shall be submitted to the Township Clerk and shall be reviewed and approved by the Chief of the Police and Fire Department. Approval shall be based upon the conditions that exit and entrance ways are adequate for the passage of motor vehicles, emergency fire or ambulance vehicles and that there is compliance with all conditions of this article. The plat plan shall be to a scale of one inch equals 50 feet and shall be prepared by a licensed land surveyor or engineer.
All licenses shall be revocable by the Mayor and Township Council for the violation of any of the terms of this article upon due notice and hearing.
The permits or licenses issued hereunder are not transferable or assignable except with the consent of the Township Council and the business or occupation shall be conducted only at the place therein specified.
This article shall not apply nor shall any license be required where premises are used for open air parking for a temporary period not exceeding two consecutive days, provided there shall be no over night parking on the premises and entrance and exit to the premises be made through normal driveways and not over the curbs.
A.
Where any person operates a parking lot without charge or fee to some users and does make a charge or fee to other persons using the lot a license shall be required under this article.
B.
At no time other than in an emergency shall the repair of vehicles be permitted within the area designated as the open air parking station.
The annual license fee for open air parking stations for motor vehicles shall be determined by multiplying the number of square feet of the area occupied by the open air parking station by $0.02. If at the time of application for a license under the provisions of this article, less than six months of the licensed year have expired, the applicant shall be required to pay the full fee for the year. If six months shall have expired the applicant shall be required to pay 1/2 of the full fee for the year.
It shall be the duty of the Department of Public Safety to supervise the operations of all open air parking stations, and to prosecute all violations of this article in the Municipal Court.
Prior to the issuance of any such license, the applicant shall file with the Township Clerk a policy or certificate of public liability insurance in an amount not less than $25,000 in respect of injury to one person, $50,000 in respect of injury to two or more persons and $5,000 in respect to property damage, such policy or certificate to be issued by an insuror authorized to do business in the State of New Jersey.
This article is enacted for the purpose of raising revenue and for the regulation and control of open air parking stations.
