Unless the context specifically and clearly indicates otherwise,
the meaning of terms used in this Part shall be as follows:
A plumber authorized by the Township to perform installation,
repair and maintenance services for grinder pump systems.
The owner of a subdivided tract of land in which a grinder
pump or grinder pumps is/are intended to be used to move sewage.
A generally unexpected occurrence that demands immediate
action.
A manufactured device enclosed in an impervious container
containing an electrically powered pumping device for the movement
of wastewater or sewage with various operating and safety controls
as specified from time to time by the Township and owned and maintained
by the owner.
The sewage movement system as contained within an owner's
property including the inflow sewage pipe from the house, building,
or other structure to the grinder pump, the outflow sewage pipe from
the grinder pump to the point of connection to the lateral, and including
the necessary controls and wiring to energize the grinder pump and
controls.
Any property within the Township upon which there is erected
a structure intended for continuous or periodic habitation, occupancy
or use by human beings or animals and from which structure sewage
shall or may be discharged.
Any person vested with ownership, legal or equitable, sole
or partial, of any property located in the Township.
Any individual, partnership, company, association, corporation,
trust, estate or other legally recognized entity.
The sanitary sewer collection and transportation system owned
and operated by the Township.
The Township of East Pennsboro, Cumberland County, Pennsylvania,
or its designated representative.

The Township hereby authorizes and requires the installation
and use of grinder pumps, when a building drain is too low to accommodate
gravity flow of sewage or a pressure sewer has been installed abutting
the property, subject to (1) the provisions of this Part; (2) the
approval of the Township's sanitary consulting engineer; and,
(3) the approval of the Pennsylvania Department of Environmental Protection
and any other governmental agency or entity having jurisdiction.

The Township hereby approves, authorizes and directs that Grinder
Pump Model GP 2010, as manufactured by Environment/one Corporation,
or an approved equal, shall be acceptable and used in all grinder
pump systems.

Each developer shall deliver to the Township without charge, one
additional (spare) grinder pump for every 10 grinder pump systems
to be installed in any residential development. Said spare grinder
pumps are to be owned by the Township and be retained for temporary
use when an operating grinder pump fails or requires maintenance.
If any such development will require less than 10 grinder pumps, the
Township shall specify, by special action, the developer's obligation
to pay a monetary sum for a portion of the purchase price of a spare
grinder pump.

Spare grinder pumps will be available for pickup by an approved plumber
from the Township for use under emergency conditions when such pumps
are not commercially available. One such spare grinder pump shall
be delivered to the approved plumber by the Township for use in temporarily
replacing an on-line grinder pump. All remaining spare grinder pumps
shall be retained in the Township's possession, but available
to the approved plumber as needed for other temporary replacements.

Any owner who elects to purchases a spare grinder pump from the Township
for permanent use shall pay its cost for such pump plus an administrative
fee of 10% of such cost.

Owner shall at all times be required to maintain the grinder pump system in proper working order and to the level necessary to abate any nuisance or public health hazard. Each property owner served by a grinder pump shall have full responsibility for using the pump consistent with the manufacture's instructions and shall avoid introducing into the sewer system material that may damage the impellers on the pump, including, but not limited to items designated as biodegradable in septic tanks. Owner shall be wholly and solely responsible for the cost and expense of proper operation, maintenance, and repair of the grinder pump system serving said owner's improved property. Except for providing spare grinder pumps for emergency use as set forth in § 18-604, the Township shall have no responsibility for the operation, maintenance, repair or replacement of any grinder pump system. A temporarily installed spare grinder pump shall be returned to the approved plumber or Township, as the case may be, upon completion of repair or maintenance of the owner's grinder pump.

Because of the need to have monitored control and consistent performance
of grinder pump system repair and maintenance, only an approved plumber
will be permitted to install, construct, repair and/or maintain any
grinder pump system. An approved plumber shall provide evidence of
past experience in plumbing and electrical work for grinder pumps,
and provide evidence of adequate insurance coverage. Evidence of insurance
coverage shall be presented to the Township in the form of insurance
certificates. Insurance certificates shall be kept current with the
Township during the period the contractor is installing and maintaining
the grinder pumps within the Township. A list of approved plumbers
is available from the Township. An approved plumber may be removed
from the Township's listing for any of the following reasons:
A.
An approved plumber fails to maintain the required certificates of
insurance specified by the Township.
B.
Approved plumber noncompliance with the Township's ordinances,
rules or regulations.
C.
Excessive expenditures of Township personnel time and effort to monitor
an approved plumber's work performance.

It shall be unlawful for an owner of an improved property to
refuse to allow the Township to enter their property to inspect a
grinder pump system to determine whether the grinder pump system is
operating property.

Any violation of §§ 18-602 thorough 18-607 above shall constitute a nuisance and shall be abated by the Township by either seeking mitigation from the owner or by dispatching an approved plumber to repair the grinder pump system; in case of an emergency that threatens the health and safety of residents, at the expense of the owner.
2.
Any person, firm or corporation who shall violate any provision of
this Part, upon conviction thereof, shall be sentenced to pay a fine
of not more than $1,000 plus costs and, in default of payment of said
fine and costs, to a term of imprisonment not to exceed 30 days. Each
day that a violation of this Part continues shall constitute a separate
offense.
