This Part 2D shall apply to all private system which discharge
to wastewater facilities of the Borough or which discharge directly
to a natural outlet by authority of a separate NPDES permit, in accordance
with provisions of this Part and in compliance with applicable state
and federal laws.

All houses, buildings or other properties which are required
by other authority to have sanitary or industrial wastewater facilities,
are subject to the jurisdiction of this Part and are located where
a public sewer is not available as specified by the provisions of
Part 2C, shall be equipped at the owner's expense, with suitable
wastewater facilities connected to a private wastewater disposal system
which complies with the provisions of this Part.

Before commencement of construction of a private wastewater disposal system required under §
18-218 above, the owner shall first obtain a written approval from the Borough. The approval shall be in two phases. A preliminary approval will be granted prior to issuance of appropriate state and federal permits. A final approval may be requested subsequent to receipt of all appropriate state and federal permits. Construction of any facilities may not commence prior to obtaining final approval from the Borough.

The type, capacities, location and layout of a private wastewater
disposal system shall be in accordance with all applicable Borough,
Authority, state and federal requirements.

Before commencement of operation of a private wastewater disposal
system the owner shall first obtain written operating approval from
the Borough. The operating permit shall not be effective until the
installation is completed to the satisfaction of the Borough. The
Borough and Authority shall be allowed to inspect the work at any
stage of construction, and, in any event, the applicant for the operating
permit shall notify the Borough when work is ready for final inspection.
The inspection shall be made within two days after receipt of notice
by the Borough.

At such time as a public sewer becomes available, as defined in §
18-216, to a property served by a private wastewater disposal system, a direct connection shall be made to the wastewater sewer within 90 days and any septic tanks, cesspools and similar wastewater disposal facilities shall be emptied and filled with suitable material, such as clean sand, bank gravel, etc., in accordance with applicable Borough, Authority, state and federal requirements.

The owner shall operate and maintain the private wastewater
disposal facilities in a sanitary manner at all times and in accordance
with the conditions of the operating permit and at no expense to the
Borough or Authority. Such facilities shall be subject to inspection
by the Borough or Authority at reasonable times.

No statement contained in this Part shall be construed to interfere
with any additional requirements that may be imposed by other Borough,
Authority, state, federal or other applicable authorities.
