The following are established as the municipal parking lots of the Borough of Montgomery.

A. 
Provisions applicable in all lots. The Borough may cause lines and markings to be painted or placed upon the surface of the unmetered parking lots, for the purpose of delineating parking spaces for individual vehicles. It shall be unlawful and a violation of this article for any person:
(1) 
To park any vehicle across any such line or marking; or
(2) 
To park any vehicle in such a position that that vehicle is not entirely within the area designated by the lines or markings; or
(3) 
To park a vehicle elsewhere in any such lot than in such an individual parking space, the prohibited areas including, but not limited to access and exit driveways and turning and maneuvering spaces.
B. 
Provisions applicable in stated lots only:
(1) 
In the Henry Hand Drive Lot, parking is prohibited off Park Street directly opposite the Municipal Services Building.
A. 
Council, at its discretion, may provide, at convenient and suitable locations in any or all of the unmetered parking lots, reserved parking spaces for handicapped, and may designate those spaces by appropriate signs. It shall be unlawful, and a violation of this article, for any person to park in any such reserved parking space, any vehicle unless that vehicle bears or displays either: a handicapped registration plate, or a disabled veteran's registration placard. Provided: all provisions, requirements and restrictions contained in other sections of this article shall apply to vehicles lawfully parked in reserved parking spaces for handicapped or disabled veterans.
B. 
The eight parking stalls at the extreme western end of the Municipal Parking Lot at the western end of Montgomery Street and being located on Montgomery Street between Second Street and Main Street are dedicated to the new Medical Center and its patients.
C. 
An owner or occupant of a private residence may request that a handicap parking space be created on a public street in the Borough by completing a handicap parking space request form and filing the completed form with the Borough office.

(1) 
The Borough Manager shall have the authority to develop and to amend as necessary the handicap parking space request form.
(2) 
The applicant shall meet the following qualifications:
(a) 
The applicant must not have available off-street parking.
(b) 
The applicant must have a valid driver's license and a handicap license plate or placard.
(3) 
Upon approval of the request by Borough Council, the space shall be created. The Borough Manager shall have the authority to obtain and post the necessary signage and to take such other steps as are necessary to create a handicap parking space on a public street in the Borough.
(4) 
After a handicap parking space is created pursuant to this subsection, any person with a handicap license plate or placard may use the handicap parking space. The handicap parking space is not reserved solely for the applicant.
(5) 
A handicap parking space created pursuant to this subsection shall revert to regular parking when the applicant no longer meets the qualifications identified in Subsection C(2) above.
(a) 
The applicant shall notify the Borough when he or she no longer meets the qualifications identified above.
(b) 
The Borough Manager shall have the authority to remove existing signage and other indicators of handicap parking after the parking space has reverted to regular parking.
It shall be unlawful for any person to park a vehicle, or to allow a vehicle to remain parked in any unmetered parking lot: a) (b)
A. 
For longer than the maximum parking time for that lot as prescribed in § 435-27 of this article; or
B. 
At any time when the lot is not in operation, that is, otherwise than the hours of operation for the lot as prescribed in  435-27 of this article.
Any person who violates any provision of this article shall, for every such violation, be sentenced to pay a fine of $25 and costs.
