It is the intent and purpose of this Part to insure the preservation of public park lands, recreational facilities and conservation areas owned and/or leased by the Borough of Wellsboro, to regulate activities within these areas consistent with the enjoyment and preservation of unspoiled natural settings and park facilities and to prevent any nuisances to the Borough of Wellsboro in the use of such public park lands, recreation areas and conservation areas, or in the enjoyment of private property adjacent to such areas.

1. 
No person or persons except those authorized by the Borough of Wellsboro and conducting Borough business shall in recreation park or conservation areas:
A. 
Injure, deface, disturb or in any manner destroy or cause to be destroyed any part of any recreation park or conservation site owned or leased by the Borough of Wellsboro, nor any building, sign, structure, recreation apparatus, equipment or other property found therein.
B. 
Remove, injure or destroy any tree, flower, shrub, plant or growing thing or any rocks or other minerals.
C. 
Kill, trap, hunt, pursue or in any manner deliberately disturb, in such a manner as to intentionally injure or intend to injure any wild bird or animal within the recreation park and conservation areas owned or leased by the Borough of Wellsboro, except in those areas where hunting shall be permitted as designated by action of the Borough Council.
D. 
Throw, discharge or otherwise place or cause to be placed in the waters of any fountain, pool, pond, lake or other body of water in or adjacent to any park or tributary, stream, storm sewer or drain flowing into such waters, any substance, matter or thing, liquid or solid, which may result in the pollution of said waters; nor shall anyone dump, deposit or leave any bottles, broken glass, paper, boxes, cans, dirt, rubbish, waste, garbage, refuse or trash anywhere within the parks and recreation areas owned or leased by the Borough of Wellsboro; but users shall make use of trash receptacles where they are provided and where receptacles are not provided, all such debris shall be carried away from the park by the person responsible for its presence, and properly disposed of elsewhere.

1. 
Hours of Operation. Recreation park and conservation areas shall normally be open daily to the public. Restricted hours of operation will be posted at the entrance to each park recreation area or conservation area. Any section or part of any park recreation area or conservation area may be declared closed to the general public at any time and for any appropriate interval of time, either temporarily or at regularly scheduled intervals. During such periods of time, it shall be unlawful to enter upon or occupy such designated areas or portions thereof contrary to posted regulations.
2. 
Group Activity. When any Wellsboro or nonresident group or association desires to use recreation park facilities for its exclusive use, for a particular purpose, such as picnics, parties, etc., a representative of said group, association or organization shall first obtain a permit for such use in specially designated areas from the Director of Parks and Recreation, the Borough Manager, or their designated agents. The Wellsboro Borough Council may adopt an application form to be utilized by the Director of Parks and Recreation, or the Borough Manager, which may require posting of security to protect Borough property from any damage. The Director of Parks and Recreation, or Borough Manager, or their designated agents, may grant a permit if it appears that the group, association or organization will not interfere with general use of the park by individual members of the public, and if the group, association or organization meets all the conditions contained in the application. A deposit fee may be required to accompany any request for reservation of park facilities and areas.
3. 
Possession and Consumption of Alcoholic Beverages. It shall be unlawful for any person to have in his or her possession, custody or control any alcoholic beverage, including beer, of any kind whatsoever, in any park recreational areas or conservation areas owned, operated or leased by the Borough of Wellsboro.
4. 
Use of Facilities. Facilities and areas in Borough owned or leased recreation parks and conservation areas shall be used for those purposes designated or implicit in their character. Any deviation from the appropriate use shall require permission from the Director of Parks and Recreation, or Borough Manager, or the designated agents.
5. 
Motor Vehicles. Licensed motor vehicles shall be permitted only on designated roadways. The speed limit for such vehicles on such roadways shall be 15 miles per hour. Unlicensed such as motor scooters, motorcycles, minibikes, and go-carts shall not be permitted in Borough owned or leased parks, recreation areas or conservation areas. Snowmobiles may be permitted on designated trails. All vehicles shall be parked in areas or places so designated for parking. Parking in places contrary to posted regulations and times is prohibited, and such vehicles may be removed by the Borough at the owner's expense. Vehicles shall not be left unattended in a park or recreation area, after restricted dosing times, except under emergency conditions or with approval of authorities. Grass areas shall not be used for roadways, park or for other purposes which may injure or destroy the turf or the landscape. It shall be unlawful to clean, wash, repair or do any work whatsoever on private vehicles within recreation park and conservation areas except for emergency repairs.
6. 
Fees. The Director of Parks and Recreation or Borough Manager shall have the authority to propose a fee schedule, to be adopted from time to time by resolution of Borough Council, for resident and nonresident permits with regard to funds to be deposited, collected, refunded or forfeited. Such revenues received shall be deposited in the Borough general fund account.

1. 
Fires and Fireworks. Fires may not be built or allowed anywhere in park recreation or conservation areas except in stoves, fireplaces or designated areas provided for that purpose. Permits must be secured for the use and discharge of any fireworks at any time m accordance with the laws of the Commonwealth of Pennsylvania, and ordinances of the Borough of Wellsboro.
2. 
Animals. It shall be unlawful for owners of domesticated animals to permit same within parks, or recreation areas owned or leased by the Borough of Wellsboro, without such animals being controlled by a leash measuring not more than 10 feet long. Horses may be permitted on authorized or designated trails. Permits must be obtained for the training and/or exhibition of animals in designated areas.
3. 
Merchandising, Advertising and Signs. No person shall in park recreation or conservation areas:
A. 
Offer for sale any article or thing, nor station or place any stand, cart or vehicle for the transportation, sale or display of any such article or thing except under the authority of the Director of Parks and Recreation or Borough Manager by application or permit.
B. 
Announce, advertise or call to the public attention in any way any article or service for sale or hire.
C. 
Post, paste, fasten, paint, write, draw, tack or affix any placard, bill, notice, sign, advertisement or an inscription whatever upon any structure, tree, stone, fence, thing or enclosure within any park or recreation area or on any public lands or highways or roads adjacent to any park, recreation or conservation area, except that the Borough Department of Parks and Recreation may place informational, identifying or directional signs within such areas.
4. 
Solicitations for donations by groups or individuals are prohibited within park recreation or conservation areas.
5. 
Personal Conduct. It shall be unlawful for any person in any park recreation or conservation area owned, operated or leased by the Borough of Wellsboro to:
A. 
Disturb the peace or use profane or obscene language.
B. 
Endanger the safety of any person or property by any conduct or ad.
C. 
Commit any assault, battery or to engage in physical fighting.
D. 
Carry, possess or drink any alcoholic beverages including beer.
E. 
Violate any rule for the use of the park, made or approved by the Department of Parks and Recreation or the Borough of Wellsboro.
F. 
Prevent any other person from using any park, or any of its facilities or interfere with such use in compliance with this Part and the rules applicable to such use.
G. 
Act in an unlawful, disorderly or disruptive manner or contrary to the best interests of the areas or to other people within the areas.

1. 
The Borough Manager and agents designated by him, primarily the Director of Parks and Recreation, or the Director of Parks and Recreation, shall administer the provisions of this Part including the establishment and collection of fees, preparation of application forms, issuance and revocation of permits, promulgation of rules and regulations to implement the provisions of this Part and all other decisions relative thereto.
2. 
When acts or conduct of individuals or groups are determined to be violations of this Part or rules and regulations promulgated by the authority of this Part; or not to be in the best interest of Borough owned parks, recreation and conservation areas, or when such acts are deemed to be disruptive to the surrounding neighborhood, the Borough Police, the Director of Parks and Recreation, the Borough Manager or their designated agents assigned to such areas or programs shall have the authority to cause such acts to be terminated, or to expel the perpetrators of such acts from the area, or to call the Borough Police to arrest and detain such individuals, or to file a complaint for the violation of this Part with a magisterial district judge.

Any person who shall violate any provision of this Part shall, upon conviction thereof, be sentenced to pay a fine of not more than $600 plus costs and, in default of payment of said fine and costs, to imprisonment for a period not to exceed 30 days. Each day that a violation of this Part continues shall constitute a separate offense.

CONSERVATION AREA
Any unimproved tract, parcel or piece of land presently owned or leased or hereafter owned or leased by the Borough of Wellsboro, which land shall be maintained primarily in a natural state or condition.
DESIGNATED AREA
Any part of a park, conservation or recreational area, identified by identifying informational or directional signs as being set aside, designated or prescribed for a particular use, purpose or activity.
PARK AND/OR RECREATION AREA
Any improved tract, parcel or piece of land presently owned or leased, or hereafter owned or leased by the Borough of Wellsboro, and designated by Borough Council as a park or recreation area.
