The office of Borough Manager is hereby created by the Borough Council for the Borough of Dublin, subject to the right of the Borough Council, at any time by ordinance, to abolish such office.

The Borough Manager shall be appointed from time to time, and whenever there shall be a vacancy in the office, for an indefinite term by a majority vote of all members of Borough Council. The Borough Manager shall serve at the pleasure of the Borough Council and may be removed by a majority vote of all members of Borough Council.

The Borough Manager shall be chosen on the basis of executive and administrative abilities with special reference to actual experience in or knowledge of accepted practice in the duties of the office as herein set forth.

Before entering upon the duties of the position, the Borough Manager shall give a bond to the Borough in such sum as shall be required by the Borough Council, conditioned for the faithful performance of the duties of the office. The Borough shall pay the premium.

The Borough Manager shall receive such compensation as shall be fixed from time to time by Borough Council.

The Borough Manager shall be the Chief Administrative Officer of the Borough, and shall be responsible to Council as a whole for the proper and efficient administration of the affairs of the Borough. The Borough Manager shall be responsible for the general management of all Borough business not expressly, by statute or ordinance, imposed or conferred upon other Borough officers. The Borough Manager shall also act as Borough Secretary and Right-to-Know Officer unless another individual is appointed to fill that position.

With the approval of Borough Council, the Mayor may delegate to the Borough Manager, subject to recall by written notification at least 90 days in advance, any nonlegislative and non-judicial powers and duties of that office.

1. 
Subject to recall by ordinance, the powers and duties of the Borough Manager shall include the following:
A. 
The Manager shall supervise and be responsible for the activities of all services and facilities and municipal departments, except the Police Department unless so delegated by the Mayor.
B. 
The Manager shall hire, and when deemed necessary for the good of the service, shall suspend or discharge any employees under his/her supervision; subject to confirmation by Borough Council and as further subject to any law or Borough ordinance.
C. 
The Manager shall make recommendations to the Council on the compensation of all employees under his/her supervision, provided that Council shall fix such compensation.
D. 
The Manager shall prepare and submit to Council before the close of the fiscal year, or such date, as Council shall determine, a budget for the next fiscal year and an explanatory budget message. In preparing the budget, the Manager, or an employee designated by the Manager, shall obtain from the head of each department, agency, board, commission, or office, estimates of revenues and expenditures and other supporting data as deemed necessary by the Manager. The Manager shall review such estimates and revise them in consultation with the Finance Committee before submitting the budget to Council.
E. 
The Manager shall be responsible for the administration of the budget after its adoption.
F. 
The Manager shall, under the direction of the Mayor and Council, enforce all laws of the Commonwealth of Pennsylvania, and all ordinances, resolutions, and by-laws of the Borough.
G. 
The Manager shall hold such other municipal offices, or head one or more municipal departments, as the Council may from time to time direct. With the approval of Council, the Manager may hold office in any municipal authority organized by the Borough.
H. 
The Manager shall attend all meetings of the Borough Council, and may attend all committee meetings, with the right to take part in any discussions, and shall receive notice of all meetings of Council and its committees.
I. 
The Manager shall prepare the agenda for each meeting of Council and supply facts pertinent thereto.
J. 
The Manager shall keep Council informed as to the conduct of Borough affairs; submit periodic reports, as the Council may determine on the condition of Borough finances and such other reports as the Council shall request; and shall make policy and general recommendations as deemed necessary.
K. 
The Manager shall submit to Council, as soon as possible after the close of the fiscal year, a complete report on the financial and administrative activities of the Borough for the preceding year.
L. 
The Manager shall see that all moneys owed to the Borough are promptly paid and shall take all proper proceedings for the security and collection of all Borough claims.
M. 
The Manager shall see that the provisions of all franchises, leases, permits, and privileges granted by the Borough are observed.
N. 
The Manager may employ, with the approval of Council, experts and consultants to perform work and advise in connection with any of the function of the Borough.
O. 
The Manager shall attend to the letting of contracts in due form of law, and shall supervise the performance and faithful execution of the same, except insofar as such duties are expressly imposed upon some other Borough officials by statute.
P. 
The Manager shall be the Purchasing Officer of the Borough, and shall purchase, and/or approve the purchase of, in accordance with provisions of the Borough Code, all supplies and equipment for the various agencies, boards, departments, and other offices of the Borough.
Q. 
The Manager shall keep account of all purchases and shall, from time to time or when directed by Council, make a full written report thereof; the Manager shall further prepare and issue rules and regulations, subject to the approval of Council, governing the requisition and purchasing of all municipal supplies and equipment.
R. 
The Manager shall deal with all complaints regarding services or personnel of the Borough. The Manager, or his designated officer, shall investigate and dispose of all such complaints, reporting to Council on matters of significant importance to Borough policy and operations.
S. 
The Manager shall cooperate with Borough Council at all times and in all matters that the best interests of the Borough and of the general public may be maintained.
T. 
The Manager shall be responsible for planning, initiating, supervising, completing, costing and documenting all projects and activities of the Public Works, Water, Sewer and General Administration Departments. He/she shall maintain priorities in consonance with the requirements of Borough Committees and shall be responsible to such for all works and projects. He/she shall insure that all projects are accomplished in a timely and orderly manner.
U. 
The Manager shall prepare and have custody of all municipal records required by law to be kept by the Borough and not by a specific officer.
V. 
The Manager shall annually review the performance of all Borough department heads.
W. 
The Manager shall be responsible for all other duties as directed by Borough Council.

Except for the purpose of inquiry, the Borough Council, its committees and its members, shall deal with the administrative service of the Borough solely through the Manager, and neither the Council nor any of its committees or any of its members shall give orders, publicly or privately, to any subordinate of the Manager.

If the Manager becomes ill or temporarily incapacitated, or needs to be absent from the Borough, one qualified member of the Borough staff shall be designated to perform the duties of the Manager. The person so designated shall not perform such duties for a period longer than two weeks without the approval of Council.
