Hereafter, all elected officers of the Town of Carrollton, Missouri, shall take the oath of office prescribed by the ordinances of the said Town of Carrollton, Missouri, and shall officially enter upon the discharge of their duties thereafter on the fourth Thursday of April following their election. Said oath shall be given according to the ordinances of said Town, at the Town Hall in said Town at 6:00 P.M. on said day, and the newly elected Council shall forthwith convene in session thereafter.

The Mayor shall be elected by the qualified electors of the Town and shall hold his/her office for two (2) years, and until his/her successor is duly elected and qualified.

No person shall be Mayor unless he/she be at least twenty-five (25) years of age, a citizen of the United States and a resident of the Town of Carrollton at the time of, and for two (2) years next preceding, his/her election, and a householder in said Town.

The Mayor shall be President of the Council, but shall not vote except in case of tie; he/she shall have the superintending control of all the officers and affairs of the Town, and shall take care that the ordinances of the Town and State laws relating to the Town are complied with.

The Mayor shall approve all official bonds. He/she shall sign all warrants drawn on the Treasury for money, and shall cause the Clerk to attest the same and to affix thereto the Seal of the Town, and to keep an accurate record thereof in a book to be provided for that purpose. The Mayor and the Clerk shall execute all contracts to which the Town shall be a party.

The Mayor shall, from time to time, communicate to the Council such measures as may, in his/her opinion, tend to the improvement of the finances, police, health, security, ornament, comfort and general prosperity of the Town. The Mayor shall cause to be made out and published in some newspaper, published in the Town, a correct statement of all monies received and expended on account of said Town for each year.

The Mayor shall cause public notice to be given of the time and place of holding each election for Town Officers, which notice shall be given not less than ten (10) nor more than twenty (20) days previous to the election, and in case a special election, for any purpose, is ordered by the Council, a like notice shall be given by the Mayor.

That the Mayor of the Town of Carrollton be, and he/she is hereby invested with the power and authority to suspend any police officer of said Town who shall be guilty of negligence in office, or of criminal conduct, or who shall wilfully disobey orders, become intoxicated while on duty, or shall gamble, or go to sleep while on duty, or shall use violent, rude or abusive language to any member of the Council or superior officer, or to any citizen or stranger, or shall use excessive cruelty in making arrests, or, when not in the discharge of his/her duties, any officer shall enter any gambling room or place used for immoral purpose, or loiter about any room, hall or house where any game is played for gain. And no police officer when suspended shall be entitled to receive any compensation during such suspension, provided that any police officer against whom any of the charges above-stated shall be made shall have the right to be heard, and to introduce evidence on his/her behalf. And provided further that the Mayor in no event shall have the power under the provisions of this ordinance to finally discharge any police officer, but such power shall rest with the Council.
The Mayor's and each Council member's annual salary shall be fixed by ordinance. Such salary shall be payable in equal monthly or semimonthly installments as provided by ordinance. Every other officer or assistant shall receive such salary or compensation as the Council shall provide by ordinance or resolution, payable in equal monthly or semimonthly installments. The salary or compensation of all other employees of the Town shall be fixed by the Council and shall be payable monthly or at such shorter periods as the Council shall determine.

The Council of the Town of Carrollton, shall consist of the Mayor, one (1) Councilman elected at large and one (1) Councilman elected from each ward. The Attorney, Chief of Police and Clerk shall be ex officio members of the Council but shall have no voting power.

The Councilman elected at large shall be elected by the qualified voters of the entire Town and shall hold his/her office for a period of two (2) years and until his/her successor is elected and qualified, and shall at the time of his/her election be at least twenty-five (25) years of age, a citizen of the United States and shall have resided in the Town for a period of one (1) year next preceding his/her election. The Councilmen elected from each ward shall be elected by the qualified voters of his/her respective ward and shall hold his/her office for a period of two (2) years and until his/her successor is elected and qualified, and shall be at the time of his/her election be at least twenty-five (25) years of age, a citizen of the United States, and an inhabitant of the Town for one (1) year next proceeding his/her election.

The Mayor shall be President of the Council, but shall not vote, except in case of a tie vote. The Council, at the first meeting after their election, shall choose by ballot a President Pro Tempore from their own number, who shall hold his/her office until the next election of Town Officers and he/she shall preside at the meetings of the Town Council in the absence of the Mayor; provided, that in the absence of the Mayor and of the President Pro Tempore, the Council may select by voice vote, one (1) of its members to preside at such meeting, and the member so selected shall be styled "Acting President Pro Tempore."

The Council shall hold two (2) regular meetings each month to be held on the first and third Mondays and to begin at 6:00 P.M. All meetings of the Council shall be held in the Town Hall of the Town of Carrollton, which is hereby made the Council Chamber and shall be open to the public, except when the Council, by majority vote, is in executive session.

Adjourned meetings of any regular meeting may be held for the completion of any unfinished business of the regular meeting at such time as may be provided by the Council and all business that might be taken up by the Council at the regular meeting may be considered at the adjourned meeting.

Special Council Meetings. Special meetings of the Council may be held at any reasonable time by the Mayor or President Pro Tempore notifying each Council member, the Town Clerk and Town Attorney.

Three (3) Councilmen and the Mayor, or in his/her absence, the President Pro Tempore, shall constitute a quorum to do business but a less number may adjourn from day to day and compel the attendance of the Mayor, any member of the Council or Clerk and any one (1) who shall fail or refuse to appear unless for good cause shown, shall be considered in contempt of the Council and fined in a sum not to exceed ten dollars ($10.00) and the same shall be deducted from his/her salary.

It shall be the duty of each member of the Council to be present at every meeting of the Council, unless leave of absence be granted by the Mayor; or he/she be ill and unable to attend.

The Mayor of the Town shall preside at all meetings of the Council and shall take his/her chair at the regular meeting hour or at the hour which the Council shall have adjourned from the previous meeting, and shall immediately call the members of the Council to order; he/she shall then preserve decorum and order; he/she shall hear all motions, orders, resolutions, petitions, ordinances and memorials offered or introduced by any member of the Council and shall put all questions to the Council for debate and discussion and shall submit all orders, motions, resolutions, petitions, ordinances and memorials for the vote and roll call of the Council; he/she shall preside at said meetings and perform his/her duties as such presiding officer in accordance and in harmony with the generally recognized customary and usual practice of parliamentary law; he/she may speak on all points of order one (1) time and shall decide such points of order; subject, however, to an appeal to the Council by any member, and in that case he/she shall be bound and abide by the decision of said Council upon appeal, and upon failure, neglect or refusal of the Mayor to perform any duty herein imposed or any duty incident to any responsibility herein imposed, at the time and in the manner herein set forth, the President Pro Tempore of the Council may thereupon take the chair and preside and do and perform the acts and duties herein imposed upon the Mayor and in the same manner as herein set forth, as though the Mayor was not present but absent.

In case of the permanent absence of the Mayor, or his/her temporary absence or disability to perform the duties of his/her office, the President Pro Tempore of the Council shall perform the duties of the Mayor until the Mayor shall return, or such disability is removed.

The President shall, at each meeting, announce to the Council the business in order, agreeably to the rule.

Any member of the Council may demand that any motion or resolution made or offered, be reduced to writing before being debated, amended or adopted. When a motion or resolution is made and seconded, it shall be stated by the Chair, or read aloud by the Clerk, before it is debated, amended or adopted.

The "yeas" and "nayes" of the members on all ordinances, resolutions and written reports of all committees, shall be entered on the minutes of the Council and preserved.
