No telecommunications facility shall be sited, located, constructed, erected or modified without the issuance of a building permit and such other permits or approvals as are prescribed in this chapter.
A "co-located/existing structure antenna" is any antenna that will be mounted to an existing telecommunications tower, smokestack, water tower or other existing structure, and extends no more than 10 feet above the existing structure and is no more than one inch in diameter if a rod or pole antenna and no more than 28 inches in diameter if a dish antenna.
A. 
A co-located or existing structure antenna, as defined in § 204-5, is permitted in all zoning districts without a tower special use permit, upon issuance of a building permit. The building permit application shall include the following:
(1) 
A structural analysis/report, certified by a New York State licensed professional engineer or architect, verifying the ability of the structure to handle the antenna.
(2) 
Certification by a qualified radio frequency engineer (signed and sealed by a professional engineer or architect licensed in the State of New York) that the cumulative emissions from all antennas proposed to be located at the proposed site meet federal guidelines.
B. 
The height of the new antenna shall extend no more than 10 feet above the height of the existing structure or tower.
C. 
The antenna and any mounting structure and related equipment shall be integrated into said structure in such a manner as to minimize their visual impact to the greatest extent practicable.
D. 
The fee for the co-location permit application is hereby established at $1,000.
A. 
For all other telecommunications facilities, a tower special use permit to be issued by the Village of Elmira Heights Zoning Board of Appeals shall be required pursuant to the provisions of Chapter 220 of the Village local laws shall be required.
B. 
The maximum height of such telecommunications tower, including attached antennas, shall be 125 feet measured from the ground surface immediately surrounding the site.
C. 
Such telecommunications tower shall be set back a minimum of 1 1/2 times the height of the tower and antennas from all power lines and existing buildings and residences. The Village of Elmira Heights Zoning Board of Appeals may require an additional setback area in case of guyed wires, taking into consideration the length of guyed wires and location of ground anchors.
D. 
All special use permit applications for telecommunications facilities shall be treated as an unlisted action under the State Environmental Quality Review Act (SEQRA).[1]

E. 
The Village of Elmira Heights Zoning Board of Appeals is authorized to grant a variance with respect to such height and setback requirements pursuant to the provisions of Chapter 220 of the Village of Elmira Heights Code.
