Village of Waterford, WI Article I Specific Boards and Commissions

§ 5-1 Board of Review.

A. Membership. The Board of Review shall consist of the Village President, the Village Clerk, and two Village Trustees who shall be appointed annually by the Village President and approved by the Village Board. Two alternate members, who shall be citizens of the Village and may be Village Trustees, shall also be appointed annually by the Village President and approved by the Village Board. One or both of the alternate members shall serve as replacements for regular Board members who are absent or who are removed pursuant to Wis. Stats. § 70.47(6m).

B. Organization. The Board of Review shall be organized in accordance with Wis. Stats. § 70.46.

C. Compensation. Each member of the Board of Review shall receive such compensation for attendance at Board of Review meetings as shall be determined by the Village Board.

D. Powers and duties. The Board of Review shall have the powers and duties provided by Wis. Stats. § 70.47.

§ 5-2 Library Board.

A. Membership. The Library Board shall be composed pursuant to Wis. Stats. §§ 43.54 and 43.60, as follows:

(1) Five members shall be appointed by the Village President, subject to confirmation by the Village Board, to three-year terms. One of such members shall be a school district administrator or an administrator's representative; not more than one member shall be a Trustee; and the remaining members shall be citizens appointed at large.

(2) Pursuant to Wis. Stats. § 43.60(3), a County Chairperson, with the approval of the County Board, may appoint an additional member(s) of the Library Board from among the residents of the county, as follows:

(a) Whenever the annual sum appropriated by the county to the Waterford Public Library during the preceding fiscal year:

[1] Is equal to at least 1/6, but less than 1/3, of the annual sum appropriated to the Waterford Public Library by the Village of Waterford, one additional member;

[2] Is equal to at least 1/3, but less than 1/2, of the Village's appropriation, two additional members;

[3] Is equal to at least 1/2, but less than 2/3, of the Village's appropriation, three additional members;

[4] Is equal to at least 2/3, but less than the Village's appropriation, four additional members;

[5] Is equal to at least the Village's appropriation, five additional members.

(b) The County Chairperson may appoint a County Supervisor to serve as a member of the Library Board, but no more than one County Supervisor so appointed may serve on the Library Board at the same time.

(c) The term of each additional member appointed pursuant to this subsection shall be three years from the May 1 next succeeding such appointment and thereafter for a term of three years.

(d) If an additional member appointed to the Library Board under this subsection loses the status upon which the appointment was based, the member ceases to be a member of the Library Board effective on the following May 1.

B. Duties and powers. See Wis. Stats. § 43.58.

C. Library property.

(1) Unauthorized removals. No person shall remove from the public library any book, periodical, pamphlet, picture or other article or property belonging to or in the custody of the public library without first having the same charged out as provided by rules and regulations of such library.

(2) Correct name and address required. No person shall register or furnish a false name or address to the public library.

(3) Registration card. No person shall use any registration card other than his own to draw any book, periodical, pamphlet, picture or other article or property without the authorization of the named registrant to draw the specific item.

(4) Destruction of property. No person shall willfully or maliciously damage or destroy any book, periodical, pamphlet, picture or other article or property belonging to or in the custody of the public library.

(5) Failure to return borrowed articles. No person shall retain or fail to return any book, periodical, pamphlet, picture or other article of property borrowed from the public library for more than 15 days from the mailing of a letter of notice of demand for the return thereof, addressed to such person at the last address furnished to the library.

§ 5-3 Plan Commission.

A. Membership. Pursuant to Wis. Stats. § 62.23(1), and pursuant to the power granted to the Village Board to provide by ordinance for the membership of the Commission by § 62.23(1)(a), the members of the Village Plan Commission shall be appointed by the Village President, who shall appoint himself to the Plan Commission and shall also appoint himself presiding officer. The Village President shall also appoint one Trustee of the Village Board and five citizen members (electors) to staggered three-year terms, which shall expire in April.

B. Organization. The Plan Commission shall be organized as provided in Wis. Stats. § 62.23.

C. Powers and duties. The Village Plan Commission shall have all the powers and duties granted or assigned to plan commissions by Wis. Stats. § 62.23, and shall have such additional powers and duties as may be granted or assigned to such Commission by the Village Board or by Village ordinances. See also Chapter 235, Subdivision of Land, particularly § 235-8.

§ 5-4 Board of Appeals.

A. Membership. The Board of Appeals shall consist of five members and two alternate members appointed by the Village President, subject to confirmation by the Village Board as provided in Wis. Stats. § 62.23(7)(e).

B. Powers and duties. The Board of Appeals shall have the powers and duties provided by Wis. Stats. § 62.23(7)(e), and such other powers and duties as may be provided by the Village Board or by Village ordinances. See also Chapter 245, Zoning, § 245-54.

§ 5-5 Fire Commission.

A. Purpose. The purpose of this section is to establish a Village Fire Commission and set forth its organization, powers and duties, to further the health, safety, and welfare and wise use of resources for the benefit of current and future residents of the Village, with significant citizen involvement.

B. Authority; establishment. The Village Board hereby establishes a five-member Fire Commission under Wis. Stats. § 61.65.

C. Membership. The Fire Commission shall consist of five citizens appointed by the Village President, subject to confirmation by the Village Board. Three Commissioners shall constitute a quorum, and no more than three shall belong to the same political party. The Commission shall keep a record of its proceedings.

D. Terms of office. Each member of the Fire Commission shall be appointed for a term of five years. The Village President shall annually, between the last Monday of April and the first Monday of May, appoint in writing, to be filed with the Secretary of the Commission, one member for a term of five years, except the initial Commission, which shall be appointed in its entirety with varying terms.

E. Vacancies. A person who is appointed to fill a vacancy on the Fire Commission shall serve the remainder of the term.

F. Organization. The Fire Commission shall meet in May of every year to designate a President and Secretary from among its members and assign duties to each of them as are common to such offices. The Commission shall establish reasonable rules of procedure and shall meet monthly as needed upon proper notice upon the call of the Commission President. The Commission shall inform the Village Administrator of its meetings, the topics thereof, and the actions taken, and may avail itself of the resources of the Administrator and the Village in performing its statutory duties.

G. Powers and duties. The powers and duties of the Fire Commission shall be those set forth in Wis. Stats. § 61.65 and elsewhere in the statutes; provided, however, that the Commission shall not have the optional powers set forth in Wis. Stats. § 62.13(6).

§ 5-6 Board of Health.

A. The Village may fulfill its duties of enforcement of state laws and policies and of this Code regarding public health by entering into an intergovernmental agreement for the provision of services consistent with § 251.02(3r), Wis. Stats., and may appoint representatives to a Board of Health established thereunder. In the event that the Village does not participate in a multiple municipal local health department pursuant to § 251.02(3r), Wis. Stats., the Village Board shall continue and establish a local health department as set forth in § 251.02(3m), Wis. Stats., and shall act as the Board of Health pursuant to § 251.03(4m), Wis. Stats., and shall have all the duties and powers delegated the Board of Health by this Code and state statutes. The Village Board may enter into all contracts and make such expenditures as are necessary to fulfill its duties hereunder.

B. Duties. The Board of Health that the Village is a member of, or which is established hereunder, shall assume the general administration of health and sanitation laws and regulations in the Village, supervise the work of the Health Officer and attend to the administration and enforcement of the health laws of the state and the rules and regulations prescribed by the State Department of Health and Family Services and the ordinances of the Village.

C. Powers. Such Board shall take such measures and make such rules and regulations as are necessary and effectual for preserving and promoting the public health in the Village.

§ 5-7 Community Development Authority.

A. Creation. The Village Board, having found, determined and declared that the undertaking of programs and projects for blight elimination and prevention, slum clearance and prevention, urban renewal and redevelopment, and community development and redevelopment (collectively, "qualified redevelopment projects") will encourage well-planned, integrated, stable, safe and healthful neighborhoods, the provision of healthful homes, a decent living environment, adequate places of employment for the people of the Village and an increase in the general property tax base of the Village, and that there exists within the Village a need for qualified redevelopment projects, and that creation of a community development authority in the Village will serve the public interest, pursuant to Wis. Stats. §§ 66.1335 and 66.1339, hereby creates a community development authority in the Village, which authority shall be known as the "Community Development Authority of the Village of Waterford, Wisconsin."

B. Powers and duties. Said Authority (the "Authority") shall be a separate body politic for the purpose of carrying out qualified redevelopment projects, and shall have all powers, duties and functions of community development authorities contained in Wis. Stats. § 66.1335, as amended from time to time. The Authority shall also act as the agent of the Village in planning and carrying out community development programs and activities approved by the Village Board and the Village President under the federal Housing and Community Development Act of 1974.

C. Bylaws. The Village Board hereby establishes and approves bylaws and rules of procedure attached to Resolution No. 425.[1] The Authority may amend the bylaws as it shall deem appropriate from time to time; however, Section No. 2 of the bylaws, entitled "General Powers and Duties," shall not be amended without the approval of the Village Board.

D. Membership. The Village President shall appoint seven qualified resident persons as Commissioners of the Authority, which appointments shall be subject to confirmation by the Village Board. Two of said Commissioners shall be members of the Village Board, and shall serve on the Authority during their respective terms of office as Village Board members. The initial appointments of the five non-Village Board Commissioners shall be for the following terms: two Commissioners for one year, one Commissioner for two years, one Commissioner for three years, and one Commissioner for four years. Thereafter, the terms of the non-Village Board Commissioners shall be four years and until their successors are appointed and qualified.

E. Compensation. Compensation of the Commissioners shall be on the same basis as that of other commission members of the Village of Waterford as provided in Village of Waterford Municipal Code § 50-6, and Commissioners shall be reimbursed for their actual and necessary expenses as provided in Wis. Stats. § 66.1335(2)(d).

§ 5-7.1 Tourism Commission.

A. Purpose. The purpose of this section is to establish a Village Tourism Commission and set forth its organization, powers and duties, to further tourism promotion and tourism development in the Village, including marketing projects and transient tourist informational services that are significantly used by transient tourists and reasonably likely to generate paid overnight stays at establishments upon which room taxes are imposed.

B. Authority; establishment. The Village Board hereby establishes a six-member Tourism Commission under Wis. Stats. § 66.0615(1m)(c).

C. Membership. The Tourism Commission shall consist of five Village residents and one person, who may or may not be a resident, who shall represent the Wisconsin hotel and motel industry. The Commissioners shall be appointed by the Village President and confirmed by a majority vote of the members of the Village Board who are present when the vote is taken. At least two trustees shall be appointed to the Commission. Four Commissioners shall constitute a quorum. The Commission shall keep a record of its proceedings.

D. Terms of office. Each member of the Tourism Commission shall be appointed for a term of one year, shall serve at the pleasure of the Village President, and may be reappointed.

E. Vacancies. A person who is appointed to fill a vacancy on the Tourism Commission shall serve the remainder of the term.

F. Organization. The Tourism Commission shall, at its first meeting, and subsequently in May of every year, designate a Chairperson, Vice Chairperson, and Secretary from among its members and assign duties to each of them as are common to such offices. The Commission shall meet quarterly and/or as needed upon proper notice upon the call of the Commission Chair. The Commission shall inform the Village Administrator of its meetings, the topics thereof, and the actions taken and may avail itself of the resources of the Administrator and the Village in performing its statutory duties.

G. Powers and duties. The powers and duties of the Tourism Commission shall be those set forth in Wis. Stats. § 66.0615. The Commission shall report annually to the Village the purposes for which the revenues received were spent and shall report any delinquencies or inaccurate reporting to the Village.

§ 5-7.2 Architectural Review Board.

A. The Village shall appoint an Architectural Review Board to assist and provide recommendation to the Village Plan Commission based on the conditions of the Village Architectural Standards.

B. The Village Plan Commission members shall serve as the Architectural Review Board unless the Board of Trustees appoints five residents with one-year terms to serve as the Architectural Review Board. Unless the Board of Trustees appoints an Architectural Review Board all references in this section shall be to the Village Plan Commission.

C. The Architectural Code adopted by the Village shall be for all zoning districts, to promote the health, safety, aesthetics, and general welfare in and of the Village, by:

(1) Protecting the general appearance of buildings, structures, and open areas; and

(2) Ensuring adequate light, air and privacy for property; and

(3) Encouraging architectural standards that promote high quality design and use of quality materials, and composition of materials, that are attractive and compatible with existing buildings, and to maintain property values.
