Pursuant to § 3-308 of the Village Law, the Board of Trustees of the Village of Clyde, New York, hereby creates a Board of Water and Sewer Commissioners composed of five persons whose terms shall start April 1, 2017. Terms of office will be three years. The original members shall be appointed for terms of one, two and three years so that one member's term shall expire each year.
As used in this chapter, the following terms shall have the meanings indicated:
SEWER COMMISSION
The Sewer Commission of the Village of Clyde, New York. (see "Water Commission").
VILLAGE
The Village of Clyde.
WATER COMMISSION
The Water Commission of the Village of Clyde, New York. (see "Sewer Commission").
A. 
The Board of Water and Sewer Commissioners shall review, monitor and recommend changes deemed necessary to the rules and regulations concerning the sale of water, the collection of rents and charges, installation of services and meters, extension of mains and general rules pertaining to the water distribution system and sanitary sewer system throughout the Village of Clyde, New York, and any other territory served by the Village of Clyde Water Department.
B. 
All rules and regulations are subject to approval by the Board of Trustees of the Village of Clyde.
C. 
The Board of Water and Sewer Commissioners shall suggest a rate schedule for water use and sewer rents, but the Board of Trustees of the Village of Clyde reserves the ultimate authority to set and establish water rates and sewer use rates.
At the expiration of each member's term of office, the Board of Trustees of the Village of Clyde, New York, shall appoint a new member to the Board of Water and Sewer Commissioners to replace the person whose term has expired or shall reappoint that person for an additional term of three years.
The quarterly minimum rate charge shall be as set by the Board of Trustees.[1]
