The purpose of this chapter is to regulate and
make safer the traffic upon the streets and highways within the corporate
limits of the Village of Tivoli, New York, hereinafter referred to
as the "Village."
A.
The words and phrases used in this chapter shall,
for the purposes of this chapter, have the meanings respectively ascribed
to them by Article 1 of the Vehicle and Traffic Law of the State of
New York.
B.
CURBLINE
MUNICIPAL PARKING LOT
OFFICIAL TIME STANDARD
The following words and phrases which are not defined
by Article 1 of the Vehicle and Traffic Law of the State of New York
shall have the meanings respectively ascribed to them in this section
for the purpose of traffic and safety regulations within the Village:
The prolongation of the lateral line of a curb or, in the
absence of a curb, the lateral boundary lines of a roadway.
A plot of land or building owned/leased by the Village, not
including streets and highways, upon or within which the parking of
vehicles is regulated by ordinance and/or traffic control devices.
Whenever certain hours are named herein or on traffic control
devices within the Village, they shall mean the time standard which
is in current use by the State of New York.
The Board of Trustees of the Village shall install
or maintain, or cause to be installed or maintained, all traffic control
devices when and as required under the provisions of said law and
may install and maintain, or cause to be installed or maintained,
such additional traffic control devices as it may determine necessary
to regulate, warn or guide traffic under the Vehicle and Traffic Law
of the State of New York, subject to provisions of §§ 1682
and 1684 of said law.
A.
Broadway (Dutchess County Route No. 78, hereinafter
referred to as "Broadway") is hereby designated a highway with stop
signs erected on said highway from the east and west at the respective
intersections of Broadway and North Road, and Broadway and Montgomery
Street. Street stop signs shall be erected at the following entrances
thereto:
(1)
Friendship Street from both the north and south.
(2)
Woods Road from the north.
(3)
Pine Street from the north.
(4)
North Road from the north.
(5)
Clay Hill Road from the south.
(6)
Montgomery Street from the south.
(7)
Flora Street twice from the north.
(8)
Dock Road from the south.
(9)
The road behind the War Memorial twice from the north.
(10)
Diana Street from the west.
B.
North Road from Broadway north is hereby designated
a through highway, and stop signs shall be erected at the following
entrances thereto:
(1)
Pine Street from the west.

The provisions of this section shall apply except when it is
necessary to stop a vehicle to avoid a conflict with other traffic
or in compliance with the directions of a police officer, other emergency
personnel, or an official traffic control device.
A.
No overnight parking seasonally. The parking of a vehicle is hereby
prohibited on all streets within the Village between 1:00 a.m. and
6:00 a.m. from November 15 through April 1. Violators of this section
shall be fined and their vehicles towed at the owner's expense.
B.
Prohibition of stopping, standing or parking in specified places.
Except when necessary to avoid conflict with other traffic, or in
compliance with the law or directions of a police officer or other
emergency personnel or official traffic control device, no person
shall, within the Village, stop, stand or park in the following areas,
which shall be designated by signs in compliance with the sign standards
of the State of New York or by the marking of the curbline with yellow
paint:
(1)
On the east side of North Road from the north curbline of Broadway
to a point 25 feet to the north and on the east side of North Road
within a distance of six feet of either curbline of a private parking
lot.
(2)
On the west side of North Road from the north curbline of Broadway
to the south curbline of Pine Street.
(3)
On the west side of Montgomery Street.
(4)
On the north side of Broadway between the intersection of the road
that runs behind the War Memorial with said Broadway; on the north
side of Broadway from the west curbline of North Road to a point 25
feet to the west; on the north side of Broadway from the west curbline
of Montgomery Street to a point 25 feet to the west; and on the north
side of Broadway from the east curbline of North Road to a point 25
feet to the east.
(5)
On the south side of Broadway from the west curbline of Montgomery
Street to a point 25 feet to the west; on the south side of Broadway
within a distance of six feet of either curbline of Feroe Avenue;
on the south side of Broadway within a distance of six feet of either
curbline of the Post Office parking lot curbline; and on the south
side of Broadway within a distance of six feet of either curbline
of a private parking lot.
(6)
On either side of Feroe Avenue.
(7)
On the north side of Washburn Avenue.
(8)
On the south side of Spring Street.
(9)
On the side of any street from the curbline to a point 25 feet from
that curbline.
(10)
On either side of Clay Hill Road from the west curbline of Route
No. 9G to a point 200 feet to the west.
(11)
Blocking any driveway.
(12)
Against the direction of traffic on the side of the street where
the vehicle is located.
(13)
On any public sidewalk or within any crosswalk area.
(14)
On the travel side of any parked, stopped or standing vehicle
(double parking).
C.
Limitations of stopping, standing or parking in fire zone. Except
when necessary to avoid conflict with other traffic, or in compliance
with the directions of a police officer or other emergency personnel
or official traffic control device, no person shall, within the limits
of the Village, stop, stand or park in the following areas, which
shall be designated by signs in compliance with the sign standards
of the State of New York or by the marking of the curbline with yellow
paint: within the boundaries of the fire zone in front of the firehouse,
as designated by the Village Board of Trustees.
D.
Limitations of stopping, standing or parking in specified areas.
Except when necessary to avoid conflict with other traffic, or in
compliance with the directions of a police officer or other emergency
personnel or official traffic control device, no person shall, within
the limits of the Village:
(1)
Overtime parking: stop, stand or park a vehicle for a continuous
time in excess of 15 minutes:
(a)
On the south side of Broadway in front of the United States
Post Office and 40 feet to the west between the hours of 9:00 a.m.
through 5:00 p.m. from Monday through Friday, excluding all nationally
recognized holidays.
E.
No parking near hydrant. No person shall park any vehicle more than
15 feet to the left or right of any hydrant within the Village limits.
F.
Unpaid
parking tickets.

(1)
When
any vehicle is found to have three or more outstanding or unpaid parking
tickets and is parked on any public highway, off-street parking lot,
public parking garage or property leased by, or in the possession
and control of, the Village of Tivoli, such vehicle may be removed
under the direction of the Mayor or any member of a law enforcement
agency with jurisdiction in the Village by towing or otherwise.
(2)
Within
24 hours after towing, the Village Clerk shall notify the owner of
such vehicle of the fact of its towing, the place where it may be
recovered and the conditions under which it will be released.
(3)
The
Village may arrange for the storage of any such vehicle found to be
in violation of this chapter at the expense of the owner. The owner
or person in charge of the vehicle may have said vehicle released
upon payment to the Village of Tivoli of all outstanding violations,
parking fines, towing charges, storage fees and any administrative
charges. Such storage fees and administrative charges shall be set
by resolution of the Board of Trustees.
G.
The parking,
standing or stopping of vehicles other than buses is hereby prohibited
in areas designated as bus stops, which shall be designated by signs
in compliance with the sign standards of the State of New York or
by the marking of the curbline with yellow paint. The following location(s)
are hereby designated as bus stop(s):

(1)
On
the north side of Pine Street, from the curbline at the intersection
of Pine Street with the north/south portion of Pine Street, continuing
easterly for a distance of 150 feet.
A.
Any vehicle left unattended or unmoved for a period
of time in excess of 72 hours on any public property, street, or municipal
parking lot in the Village shall be considered abandoned and shall
be towed at the owner's expense.
B.
Any vehicle left parked in violation of this section
of the law which obstructs operations during a snowstorm, flood, fire,
or other public emergency, or which is abandoned on the streets or
municipal parking lots in the Village during any such public emergency,
may be removed by the Mayor or the Board of Trustees of the Village.
The owner or operator of the vehicle will be responsible for the expense
of the removal and any necessary storage.

A.
With the exception of Route No. 9G, 25 miles per hour
is the maximum speed at which vehicles may proceed along any streets
or highways within the corporate limits of the Village, except as
otherwise provided in this section or where a different speed limit
is posted on a state highway by the New York State Department of Transportation.

B.
No person shall operate a vehicle upon Route No. 9G
in the Village at a rate of speed in excess of 45 miles per hour.

C.
Five miles per hour is hereby established as the maximum
speed at which vehicles may proceed on any parking lot owned, leased
or maintained by the Village.

D.
This section does not apply to ambulances, fire apparatus,
emergency personnel or police on emergency trips.

A.
Any person violating the provisions of § 212-6 herein (Abandoned vehicles) shall be guilty of a traffic infraction as defined in § 1800 of the Vehicle and Traffic Law of the State of New York and shall be subject to the provisions of such article.
B.
Any person violating the provisions of § 212-5E herein (No parking near hydrant) shall be guilty of a traffic infraction, which said offense, upon conviction thereof, shall be punishable by a fine not to exceed $150 or by imprisonment of not more than five days, or both such fine and imprisonment.
C.
Any person violating the provisions of § 212-5 herein (Stopping, standing and parking), except as provided in § 212-8B, shall be guilty of a traffic infraction, which said offense, upon conviction thereof, shall be punishable by a fine not to exceed $45 or by imprisonment of not more than five days, or both such fine and imprisonment.
D.
Any person violating any of the provisions of this chapter, except as provided in Subsection A or B or C of this section, shall be guilty of a traffic infraction, which said offense, upon conviction thereof, shall be punishable by a fine not to exceed $100 or by imprisonment of no more than five days, or both such fine and imprisonment.
This chapter of the Village of Tivoli shall
take effect August 1, 1996.
