Village of Greenville, WI Chapter 150 Fireworks

§ 150-1 Definition.

The term "fireworks," as used in this chapter, shall be defined as stated in § 167.10, Wis. Stats.

§ 150-2 Sale or disposal of fireworks.

It shall be unlawful for any person, firm or corporation to offer for sale at retail or to sell at retail, to loan, barter, deliver or give away, or in any other way to dispose of within the Village of Greenville any fireworks, as defined in § 150-1 of this chapter, except to holders of permits as provided in § 150-4 and § 233-3 of this Code. A seller's permit may be granted to persons, firms or corporations, provided that an application is filed with the Village. The Village President or his/her designee may issue a seller's permit, which shall be posted on location, on being satisfied that the structure meets the requirements established by the Fire Chief. A fee as prescribed in the Village Fee Schedule[1] shall be paid for required inspections.

§ 150-3 Purchasing or using fireworks.

It shall be unlawful for any person, firm or corporation to purchase at retail, use, fire, set off, discharge, or set in motion or to ignite within the limits of the Village of Greenville any fireworks as described in § 150-1, except as provided in § 150-4.

§ 150-4 Permit issued by Fire Chief.

Special permission may be granted to persons, firms, or corporations for the purchase of fireworks as described in § 150-1 and their use at a public gathering or special event, provided that an application is filed with the Village Clerk, setting forth the name of the applicant and the time and place of the exhibition. The Village Clerk shall forthwith notify the Fire Chief of the Village Fire Department of such application for special permission to use fireworks. All applications shall be referred to the Fire Chief for investigation, and no permit shall be granted unless the Village Board, from the report of a Fire Chief, determines that the applicant will use the fireworks in a public exhibition, that all reasonable precautions will be exercised with regard to the protection of the lives and property of all persons, and that the display will be handled by a competent operator and conducted in a suitable, safe place and manner. Before granting any fireworks permit, the Fire Chief shall require the applicant to post with the Village Clerk an approved insurance policy in the sum of $1,000,000 for the payment of all claims which may arise by reason of injuries to persons or property from the handling, use, or discharge of fireworks under such permit.

§ 150-5 Violations and penalties.

Any individual or entity who violates this chapter shall, upon conviction, be subject to a forfeiture of not less than $50 and not more than $1,000. Each day that a violation exists shall constitute a separate offense. The issuance of a citation shall not preclude proceedings under any other ordinance or law relating to the same or any other matter.
