A. 
There is hereby adopted by reference the National Electrical Code, 2014 Edition, and subsequent editions as adopted by the State of Oklahoma, as published by the National Fire Protection Association, for the establishment of minimum accepted standards for the design and installation of electrical conductors and equipment within or on public and private buildings or other structures, the installation of conductors that connect to the supply of electricity and the installation of other outside conductors on the premises. Such publication, save and except such portions as are hereinafter deleted, modified or amended, is hereby adopted and made a part hereof as if fully set out at length in this section.
B. 
One copy of the current National Electrical Code edition shall be on file in the office of the City Clerk and available for public inspection at all times during normal City hall business hours.

The 2014 Edition of the National Electric Code is hereby modified and amended in the following respects:
(1) 
Mounting of equipment. Exposed wood shall not be used as the means of support for electrical equipment.
Exceptions: (1) Permanently installed treated wooden poles for services; and, (2) Treated and/or painted wood siding used in conjunction with inner wall framing studs. [Ref. NEC §§ 110.13(A); 314.23]
(2) 
Island receptacles. If an island is not permanently attached to the floor and is designed to be moved easily, then the receptacle requirements of § 210.52(C)(2) shall be waived, but floor receptacles will be permitted if all other codes are followed.
(3) 
Small appliance branch circuits. Circuits serving small appliance branch circuits in kitchens shall have no more than two duplex receptacles per circuit. [Ref. NEC §§ 210.11(C)(1); 210.52(B); 210.52(C); 220.52(A)]
(4) 
Residential bathroom branch circuits. Bathroom circuits serving a receptacle(s) in a bathroom shall be dedicated to that bathroom only. Each branch circuit serving a receptacle(s) in a bathroom are required to be dedicated to bathrooms only. [Ref. NEC § 210.11(c)(3)]
(5) 
Nonmetallic sheathed cable; Types NM, NMC, and NMS. NM, NMC, and NMS shall only be allowed in residential dwellings where they are of building types IV and V (wood only). This excludes metal framed buildings of any type, regardless of use. All wiring where exposed must be protected from physical damage to a minimum height of eight feet above the nearest finished surface. [Ref. NEC § 334.10]
(6) 
Underground feeder and branch circuit cable; Type UF. Type UF cable shall be allowed inside residential dwellings where they are of building types IV and V (wood only). Type UF cable shall be allowed outside any building, specifically permitted in Chapter 340, where the wiring does not enter therein and is protected according to all other portions of the NEC.
(7) 
Open wiring on insulators. Concealed knob-and-tube wiring shall not be permitted. Existing systems shall not be extended in any manner.

There is hereby adopted by reference Annex H, Administration and Enforcement, of the National Electric Code, 2014 Edition, with the additions, insertions deletions and changes, if any, prescribed in § 5-53.

Annex H, Administration and Enforcement, of the National Electric Code, 2014 Edition, is hereby revised and amended as follows:
(1) 
Section 80.9 is amended by adding subparagraph (D) to the end thereof as follows:
(D)
Moved buildings. Electrical systems and equipment that are a part of buildings or structures moved into or within the jurisdiction shall comply with the provisions of this code for new installations.
(2) 
Section 80.13(2) is amended to provide:

When the use of any electrical equipment or its installation is found to be dangerous to human life or property, the authority having jurisdiction shall be empowered to have the premises disconnected from its source of electric supply. When such equipment or installation has been so condemned or disconnected, a notice shall be placed thereon listing the causes for the condemnation, the disconnection, or both and the penalty under § 80.23 for the unlawful use thereof. Written notice of such condemnation or disconnection and the causes therefore shall be given within 24 hours to the owners, the occupant, or both, of such building, structure, or premises. It shall be unlawful for any person to remove said notice, to reconnect the electric equipment to its source of electric supply or to use or to permit to be used electric power in any such electric equipment until such causes for the condemnation or disconnection have been remedied to the satisfaction of the inspection authorities.
(3) 
Section 80.13(13) is amended to provide:
Whenever any installation subject to inspection prior to use is covered or concealed without having first been inspected, the authority having jurisdiction shall be permitted to require that such work be exposed for inspection. The authority having jurisdiction shall be notified when the installation is ready for inspection and shall conduct the inspection within 24 hours, excluding weekends.
(4) 
Section 80.15(G) Appeals, Subsections (1) and (2) are amended to provide:
(1)
Review of Decisions. Any person, firm, or corporation may register an appeal with the City Manager for a review of any decision of the Chief Electrical Inspector or of any Electrical Inspector, provided that such appeal is made in writing within 15 days after such person, firm, or corporation shall have been notified. Upon receipt of such appeal, the City Manager shall, if requested by the person making the appeal, hold a public hearing and proceed to determine whether the action of the Chief Electrical Inspector, or of the Electrical Inspector complies with this law and, within 15 days after receipt of the appeal or after holding the hearing, shall make a decision in accordance with his findings.
(2)
Conditions. Any person shall be permitted to appeal a decision of the authority having jurisdiction to the City Manager when it is claimed that any one or more of the following conditions exist:
1.
The true intent of the codes or ordinances described in this Code has been incorrectly interpreted.
2.
The provisions of the codes or ordinances do not fully apply.
3.
A decision is unreasonable or arbitrary as it applies to alternatives or new materials.
(5) 
Section 80.19(B) is amended by adding subparagraph (7) to the end thereof as follows:
(7)
Permits shall be valid for 180 days.
(6) 
Section 80.19(D) Annual Permits, is deleted in its entirety.
(7) 
Section 80.19(F)(3) is amended as follows:
When any portion of the electrical installation within the jurisdiction of an Electrical Inspector is to be hidden from view by the permanent placement of parts of the building, the person, firm, or corporation installing the equipment shall notify the Electrical Inspector, and such equipment shall not be concealed until it has been approved by the Electrical Inspector.
(8) 
Section 80.19(F)(4) is deleted in its entirety.
(9) 
Section 80.19(F)(5) is amended as follows:
If, upon inspection, any installation is found not to be fully in conformity with the provisions of Chapter 80, and all applicable ordinances, rules, and regulations, the Inspector making the inspection shall at once forward to the person, firm, or corporation making the installation a written notice stating the defects that have been found to exist.
(10) 
Section 80.23(B)(3) is amended as follows:
Any person, firm, or corporation who shall willfully violate any of the applicable provisions of this chapter shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine as set forth in § 1-8 of the Cushing City Code.
(11) 
Section 80.25(B) is amended as follows:
Special Consideration. By special permission of the authority having jurisdiction, temporary power shall be permitted to be supplied to the premises for specific needs of the construction project.
(12) 
Section 80.25(C) is deleted in its entirety.
(13) 
Section 80.25(D) is deleted in its entirety.
(14) 
Section 80.25(E) is amended as follows:
Disconnection. Where a connection is made to an installation that has not been inspected, as outlined in the preceding paragraphs of this section, the supplier of electricity shall immediately report such connection to the Chief Electrical Inspector. If, upon subsequent inspection, it is found that the installation is not in conformity with the provisions of Chapter 80, the Chief Electrical Inspector shall notify the person, firm, or corporation making the installation to rectify the defects and, if such work is not completed with 15 business days or a longer period as may be specified by the Chief Electrical Inspector, the Chief Electrical Inspector shall have the authority to cause the disconnection of that portion of the installation that is not in conformity.
(15) 
Section 80.27(A) is amended as follows:
Certificate. All electrical inspectors shall be certified by a nationally recognized inspector certification program accepted by the City of Cushing and Oklahoma Construction Industries Board (OCIB). The certification program shall specifically qualify the inspectors in electrical inspections. No person shall be employed as an Electrical Inspector unless that person is the holder of an Electrical Inspector's certificate of qualification issued by the OCIB. If not so qualified, an employee shall have two years from date of employment to obtain such certification.
(16) 
Section 80-27(B)(3) is amended as follows:
Be well versed in the statutes of the City of Cushing relating to electrical work and the National Electrical Code, as approved by the American National Standards Institute.
(17) 
Section 80-27(B)(4) is deleted in its entirety.
(18) 
Section 80.29 is amended as follows:
Liability for Damages. Chapter 80 shall not be construed to affect the responsibility or liability of any party owning, designing, operating, controlling, or installing any electric equipment for damages to persons or property caused by a defect therein, nor shall the City of Cushing or any of its employees be held as assuming any such liability by reason of the inspection, re-inspection, or other examination authorized.

There is hereby adopted the National Electric Safety Code, 2012 Edition, and subsequent editions as adopted by the State of Oklahoma, published by the Institute of Electrical and Electronics Engineers, Inc., as the electric safety code of the City.
B. 
One copy of such code shall be on file in the office of the City Clerk and available for public inspection during normal City hall business hours.
