A. 
Every person who owns or controls any real property or premises situated within the limits of this City, abutting on any street, alley, sidewalk or other public place, upon being notified to do so, shall trim and keep trimmed all trees on such real property and premises and the parking contiguous and adjacent thereto the branches of which overhang any portion of such streets, alleys, sidewalks or other public places in such manner that the lower most branches thereof shall be at least 10 feet above sidewalks and at least 14 feet above the level of the portion of such streets, alleys or other place so overhung by such branches.
B. 
If the owner or agent having control of any real property or premises as described in A of this section after having been notified so to do and after the lapse of a reasonable time thereafter, not to exceed 10 days, shall fail, neglect or refuse to comply with the requirements of the foregoing sections, it shall be the duty of the superintendent to cause the work to be done at the expense of the owner of such real property and premises and any expense incurred in the doing of such work shall be collected as provided or may be provided by law.

A. 
It shall be unlawful for any person to trim, cut or otherwise mutilate any shade or ornamental tree on any street, parking or other public place in the City for the purpose of stringing wires or cables along or across such parking or other public places, without first obtaining a permit therefor from the City Manager or his designee.
B. 
The City Manager or his designee shall issue such a permit if the work is necessary for the proper stringing of the wires to trim or cut any such trees, and the work can be done without serious injury to such trees.
C. 
No such trimming or cutting of trees shall be done except under the supervision and control of the City Manager or his designee or some competent person designated by the City Manager or his designee. In every case, such person shall pay the owner of such property all damages arising therefrom.

It shall be unlawful for any person to cut, scar, break or bend any limbs or otherwise injure any shade tree on the streets, alleys or public places of the City, except as provided in this article.

Each owner, agent or occupant in front of or upon whose lot or property shade trees are planted shall use every reasonable precaution to protect the shade trees from insects and worms.

A. 
Each property owner or occupant in front of or upon whose lots or property shade trees are planted shall protect the shade trees from Thridopteryx Ephemeraeformix, commonly known as the "bag worm."
B. 
When any shade trees have "bag worms" on them or any "bags" of anything from which the "bag worms" originate or grow, it shall be the duty of the park superintendent or City Manager to give the owner, agent or occupant of the property in front of or upon which such trees are planted a notice in writing to destroy the worms or "bags," or anything from which such worms originate or grow within five days from the service of such notice. When the notice is not complied with, the condition existing contrary to this article as set forth in this subsection shall be a nuisance and may be abated according to the procedure outlined in Article I of this chapter.
