The Board of Commissioners of the City of Cushing shall be composed
of five (5) members who shall be separately nominated at large and
elected at large to five (5) commissioner offices, numbered one (1)
to five (5), respectively. Commissioners shall serve without compensation.
The appointive officers of the City of Cushing shall be as follows:
City manager.
City treasurer.
City attorney.
Municipal judge.
City clerk.
City engineer.
Superintendents of waterworks, plant and sewers.
Chief of fire department.
City health officer.
Chief of police.
Street commissioner.
The terms of all elective officers elected as provided for in
Article Two, Section 1, shall begin the first Monday after their election,
and provided further that the terms of office of the commissioners
first elected under this Charter shall be as follows to-wit:
The commissioner receiving the largest number of votes shall
hold office from his election until the next succeeding general city
election, and two (2) years thereafter.
The two (2) commissioners receiving the next highest number
of votes shall hold office from their election until the next succeeding
general city election, and one year thereafter, and the two (2) commissioners
receiving the next highest number of votes shall hold office from
their election until the next general city election and all elective
offices thereafter shall be for a term of three (3) years; provided
further, that the terms of office of any and all elective officers
may be terminated at any time through and by means of the provision
of the recall, as provided in the Charter of the City of Cushing.

Each commissioner must be at least twenty-five (25) years of
age and a qualified elector of the city, not in litigation with the
city nor in arrears for city taxes when elected, nor the owner of
any stock or bonds of any public service corporation doing business
under any franchise in the city, and must have been for one year next
preceding his election a bona fide resident of the City of Cushing
or the territory legally annexed thereto.
Each commissioner elected under this Charter shall give a surety
bond, written by some surety company licensed to do business in the
State of Oklahoma, in the sum of one thousand dollars ($1,000.00),
for the faithful performance of his duties as such commissioner, the
cost of such bonds to be paid by the city, and such bonds when approved
by the city attorney, shall be deposited with, and held by the city
clerk.
No officer elected or appointed, clerk, assistant, or any employee
of the city, shall hold an office or employment in the state or county
government. No person shall be elected or appointed to any office
position or employment, the compensation of which was increased or
fixed by the board of commissioners while he was a member thereof,
at least one year from the date when he ceased to be a member of the
board.
No officer or employee of the city, whether elected or appointed,
shall be directly or indirectly interested in any contract with the
city, or with any department, board, officer or employee thereof,
nor become security for the performance of any contracts made with
or for the city, or upon any bonds given to the city. Any violation
of any provision of this section by any such officer or employee shall
be sufficient ground for removal from office. No officer of the city,
whether elective or appointive, shall be directly or indirectly connected
with, or interested in any franchise granted by the city.
Every elective or appointive officer provided for in this Charter
shall, before entering upon the discharge of the duties of his office,
take and subscribe the oath as provided by law.

If any elective officer shall die, resign or shall fail to attend
for four (4) consecutive regular meetings of the board of commissioners
unless excused for sickness or shall fail to qualify by taking the
oath of office and file his official bond as heretofore required within
ten (10) days from the time he received his certificate of election,
or if he shall otherwise become unable to discharge the duties of
his office, such office may be declared vacant by the board, or if
recalled, as hereinafter provided, said board shall thereupon appoint
some person qualified to fill the unexpired term of the person originally
elected having the qualifications for commissioner, as provided in
this Charter.
All officers appointed by the Board of Commissioners of the
City of Cushing shall have such power and perform such duties as may
be imposed on them by this Charter, or by ordinance, or resolution
of the board of commissioners.
No member of the board shall, during the term for which he shall
have been elected, be eligible to any office to be filled by the board
of commissioners.
It shall be the duty of the board of commissioners to provide
by ordinance for a system of auditing and accounting for all the affairs
of the City of Cushing, which system to be so made that it will provide
complete and accurate check and balances by one department as to all
other departments.
The board of commissioners at the end of each quarter of the
fiscal year, shall cause to be printed a detailed, itemized statement
of all receipts and expenses of the city and a summary of its proceedings
during the preceding quarter. At the end of each fiscal year, or whenever
deemed necessary, the board of commissioners shall cause a complete
audit and examination of all books, records and accounts of the city,
and all officers thereof, to be made by competent certified public
accountants, the result of which examination shall be placed on file
with the city clerk, and shall be subject to the inspection of the
public at large. The board of commissioners may also whenever they
deem advisable or necessary, have an audit made of the books, records
and accounts of any officer or employee of the city.
Each commissioner is hereby given power to administer oaths
pertaining to the business and affairs of the city.
