If any section or part of any section of this Charter shall
be found inconsistent with the Constitution and Laws of the State
of Oklahoma, relating to cities of the first class, said portion shall
be held void, and shall not be considered a part of this Charter,
and shall in no wise affect the validity of any other portion of this
Charter.
This Charter shall take effect immediately on its approval by
the governor, as provided by law.
Whenever in this Charter the word "city" may be used, it shall
be understood to, and shall be construed to mean the City of Cushing,
Oklahoma. Whenever in this Charter the word "board" appears, it shall
be understood to, and shall be construed to mean the Board of Commissioners
of the City of Cushing, Oklahoma. Whenever in the Constitution of
the State of Oklahoma or in the laws thereof relating to cities of
the first class, or any ordinances of the City of Cushing continued
in force, reference shall be made to the city council, or to the mayor
and councilmen or to the legislative body of the city, such reference
shall be deemed to be and is made to mean the "board of commissioners."
The fiscal year of the city shall begin on the first day of
July of each year and end with the last day of June of the succeeding
year.
Section 1, Article XXIII of the Constitution of the State of
Oklahoma providing that "eight (8) hours shall constitute a day's
work in all cases of employment by and on behalf of the state or any
county or municipality," is hereby adopted insofar as the same relates
to municipalities, and the same is hereby made a part of the Charter
law of the City of Cushing.
No person who is related within the third degree by affinity
or consanguinity to the commissioners or any of them, shall be appointed
or employed in any service on behalf of the city, unless such person
shall have been appointed or employed prior to the commencement of
the term of the commissioner to whom he is related.
Any violation of the provisions of this Charter or of any of
the ordinances or resolutions of the city which now exist or may hereafter
be adopted, is hereby declared an offense and the person committing
such offense shall be liable to such fine or imprisonment, or both
fine and imprisonment as may be prescribed by ordinances, resolutions
or the provisions of this Charter.

The Board of Commissioners or the City Manager of the City of
Cushing may appoint a temporary officer or officers to serve during
the time one of the regularly appointed officers is incapacitated
for any reason, absent, or is vacationing; such appointment to be
with or without bond, and may be appointed with special powers, or
with the same powers and authority as the regularly appointed, qualified
and acting officer; said temporary officer or officers to be appointed
only by the appointive powers as now provided in said Charter for
said officers.
The board of education of any independent school district within
the corporate limits of the City of Cushing may by resolution fix
the number and regulate the time and manner of electing the members
of such board of education:[;] provided that any change in the number
and in the time and manner of electing the members of such board from
that presently existing or hereafter established shall not be effective
until approved by a majority of the school district electors voting
at an election held for such purpose.

Be it remembered, that the City of Cushing, Payne County, State
of Oklahoma, did heretofore, to-wit: On the nineteenth day of March,
Nineteen Twenty-nine, hold an election for the election of eight (8)
freeholders of said city, to propose a charter for the government
of said city; and at said election, there were elected as such freeholders,
from each of the wards of said city, the following named persons:

Ward One — A.W. Little and Rex H. Winget

Ward Two — S.P. Alles and C.A. Rhoades
|
Ward Three — Fred Doye and H.J. Coleman
|
Ward Four — S.J. Berton and Joe Long
|
and said freeholders did thereupon take their oath of office,
and duly qualified as a board of freeholders to prepare, suggest and
propose a charter to be executed in duplicate and filed within ninety
(90) days from the day and date of said election.

The freeholders so elected and qualified, did organize by the
election of S.J. Berton as Chairman of the Board and Fred Doye as
Secretary of the Board.
|
The board of freeholders has prepared, formulated, adopted and
does hereby propose to the qualified electors of the City of Cushing,
the above and foregoing Charter for adoption.
|
In testimony whereof, witness our hands at Cushing, Oklahoma,
in duplicate on this thirty-first day of May, Nineteen Twenty-nine.
