The Board of Trustees of the Village of South Nyack hereby determines
that the protection of the environment is essential for the health,
safety and welfare of the public. To accomplish this goal, it is necessary
that the amount of garbage and trash to be disposed of at the landfills
be reduced and that recyclable materials be separated from garbage
and trash and marketed for reuse where feasible. This article is intended
to accomplish this goal.
As used in this article, the following terms shall have the
meanings indicated:
Normal, usual household waste, other than newspapers, glass
bottles, cans and other recyclables, primarily from perishable or
disposable items, such as leftover food matter, dishes, pots, pans
and crockery.

Printed material on a paper product known as "newsprint,"
including newspapers, newspaper advertisements, supplements, comics
and newspaper enclosures. "Newspapers" shall not include magazines,
books of any kind or cardboard.
Any person, firm, partnership, association, corporation,
company or organization of any kind.
Any item of solid waste that is nontoxic and that is determined
by the Board of Trustees to be separated from garbage and trash for
disposal at sites other than landfills.

Any item of solid waste not included within the definition
of "garbage" or "recyclables" that is nontoxic.

A.
It shall be unlawful for any person to place, deposit or permit to
be placed or deposited any newspapers, glass bottles, cans or other
recyclables within the same receptacle, package or place as garbage
and/or trash within the Village of South Nyack.
B.
Newspapers, glass bottles, cans and other recyclables shall be separately
bundled or packaged in accordance with regulations adopted by the
Board of Trustees and placed, deposited or left in the place designated
by such Board.
C.
No person shall place, deposit or leave garbage, trash, newspapers,
glass bottles, cans or other recyclables in such a manner that they
become or will become a hazard or potential hazard to public travel,
health or safety or that they will clutter or encroach on the public
right-of-way or that they will be aesthetically offensive or a public
health hazard.
D.
It shall be unlawful for any person to place or deposit garbage,
trash or recyclable containers or receptacles at curbside earlier
than the night prior to the scheduled pickup. All such containers
or receptacles shall be removed from the place of pickup within eight
hours after the contents have been removed.
The Board of Trustees of the Village of South Nyack shall, by
resolution, establish such rules and regulations as may be necessary
for the purpose of implementing this article.
The South Nyack-Grand View Police Department, the Superintendent
of Public Works or the Code Inspector shall have the power, right
and authority to enforce the provisions of this article.

Any property owner upon whose real property newspapers, glass
bottles, cans, garbage or trash is left, placed or deposited in such
a manner as to be in violation of this article or whose real property
abuts or adjoins the public right-of-way on which newspapers, glass
bottles, cans, garbage or trash have created a violation of this article
shall be presumed to be the person who left, placed or deposited such
newspapers, glass bottles, cans, garbage or trash in such place.
The Village of South Nyack shall not remove, collect or pick
up garbage or trash from the real property of any person who violates
the provisions of this article.

This article shall take effect on August 1, 1988.

This article shall be known as the "Household Trash Law."
A.
The Village
provides trash and recycling receptacles in parks and in various curbside
locations. These receptacles are intended for use by pedestrians and
commuters. They are not intended to be used by the owners of properties
and tenants of properties in the Village for general household trash
dumping or recycling.
B.
Accordingly,
the purpose of this article is to prohibit the dumping of general
household trash, debris or recyclables in Village-owned receptacles
that are intended to be used only by pedestrians and commuters.
No person shall use Village-owned trash or recycling receptacles
for the dumping of his/her general household trash, debris and recycling.

Any person found to be using Village-owned trash or recycling receptacles for the dumping of general household trash, debris and recycling shall be subject to a civil Type A penalty as set forth in § 1-15 of the Village Code.
