It is hereby declared to be, and shall be, unlawful for any person or persons within the corporate limits of the Village of Fonda, New York, to discharge, fire or use of firecrackers, rockets, torpedoes, roman candles, or other fireworks, or substances designed and intended for pyrotechnic display, and of pistols, canes, cannons or other appliances using blank cartridges or caps containing chlorate or potash mixture, provided that the Board of Trustees may authorize the public display of fireworks by properly qualified individuals if, in its opinion, such display or displays shall be of such character and so located, discharged or fired as shall not be hazardous to surrounding property or endanger any person or persons.
The sale at retail of firecrackers, rockets, torpedoes, roman candles or other fireworks or substances designed and intended for pyrotechnic display, and of pistols, canes, cannons, or other appliances using blank cartridges or caps containing chlorate or potash mixture, within the corporate limits of said Village, is hereby prohibited. The Board of Trustees may, in its discretion, remove or have removed, at the owner's expense, all stocks of fireworks exposed for sale in violation of this chapter.
Any person, firm or corporation violating any of the provisions of this chapter shall, upon conviction, forfeit and pay a penalty of not less than $5 no more than $25, and such violation is declared to be and constitute disorderly conduct, and any such person or persons violating same shall be a disorderly person.
This chapter shall take effect immediately, provided that the provisions hereof shall not apply to or be effective on July 4 in the year 1936.
