The Board of Trustees for the Village of Fonda may, upon the written application of any property owner owning property abutting upon any public street in the Village of Fonda, grant a permit to such owner for the use of the space underneath the sidewalk in front of his premises to a point three feet from the outside of the curbline (which shall leave a space underneath the sidewalk, including the width of curb, of three feet, which shall not be granted for private use).
Any such permit shall not be granted for a longer period than one year, subject to renewal by application for further periods of one year to five years. The Board of Trustees, upon 30 days' notice, may revoke any permit. Upon revocation of any such permit, the property owners shall immediately put said portion of the street in the same condition as it was before the permit was granted.
Upon the granting of such permit for the use of space underneath the sidewalk, the construction of the sidewalk and all walls with reference thereto shall be carried out according to Village laws regulating the construction of sidewalks, and, in addition thereto, such special provisions and regulations as may be determined by the Board of Trustees.
Any person violating any provision of this article may be punishable by a fine of not less than $50 nor more than $500 or imprisonment for a period not exceeding 15 days, or both.
