No owner of real property within the Village of Fonda that has a
sidewalk located between the property and the improved street margin
shall allow said sidewalk to remain obstructed by snow for a period
in excess of 24 hours after the accumulation occurs, whether the snow
accumulation is by snowfall, wind, plowing, or any other means. The
duty imposed on a property owner by this section to remove snow from
the sidewalk shall apply irrespective of whether the sidewalk is located
on the owner's property boundary line or inside the street right-of-way.
After 24 hours have expired since accumulation of snow as written
in this article, and after three hours have expired since accumulation
of snow as written in this article, the Village of Fonda shall have
the option of removing such snow and charging the expenses thereof
against the property owner at such rates as shall be established by
the Board of Trustees each year. In the event that the billing for
such snow removal is not paid to the Village of Fonda on or before
the first day of May each year, then such amounts shall be added to
the Village taxes assessed against the property and shall be collected
under the same provisions as provided for the collection of the Village
taxes.
Any violation of the provisions of this article shall be punishable
by a fine not exceeding $500 or imprisonment for a term not exceeding
15 days, or both.
In the event that personal injury or property damage shall result
from the failure of any owner or occupant to comply with the provisions
of this article, the owner and the occupant shall be liable to all
persons injured, or whose property is damaged directly or indirectly
thereby, and shall be liable to the Village of Fonda to the extent
that said Village of Fonda is required by law or by any court to respond
in damages to any injured party.
