There is hereby established for the Town a Landfill Appeals Board. The Landfill Appeals Board shall have the authority to hear appeals of Town of Suffield residents concerning the fee charged by the Town of Suffield for residential trash collection or for use of the Town transfer station for residential trash disposal.
The Landfill Appeals Board shall consist of three members: the First Selectman or his designee who shall be a member of the Board of Selectmen, the Chairperson of the Suffield Landfill Management Commission or his designee who shall be a member of the Landfill Management Commission and a year-round resident of the Town who is obligated to pay the collection/disposal fee. The resident member shall serve a renewable one-year term and may not be a member of any other Town board or commission.

The Landfill Appeals Board shall have the power to reduce the fee charged by the Town to residents for trash collection or use of the landfill transfer station. The Landfill Appeals Board shall adopt such rules and procedures as the members believe necessary to fulfill its obligations under the provisions of this chapter. In no event shall the Landfill Appeals Board have the power to reduce a resident's tax assessment. If the cost of residential trash collection/disposal becomes part of the Town's tax base, then the Landfill Appeals Board shall be disbanded and the appeals functions shall be taken over by the Board of Assessment Appeals.
Appeals shall not be granted for seasonal or other partial use of the trash service.
Refunds of user fees granted by the Appeals Board, if any, shall not be retroactive beyond the date the appeal is granted.
