It has been determined that the indiscriminate feeding of free-roaming cats and feral cats causes a public health nuisance, which is inimical to the health and general welfare of the public. The purpose of this article is to regulate such conduct.
As used in this article, the following terms shall have the meanings indicated:
FEED
To give, place, expose, deposit, distribute or scatter any edible material or water with the intention of feeding, attracting or enticing free-roaming cats or feral cats.
FEEDING PERIOD
Three four-hour periods each calendar day, the first being from 8:00 a.m. to 12:00 noon, the second being from 12:00 noon to 4:00 p.m., and the third being from 4:00 p.m. to 8:00 p.m., when a person is permitted to feed free-roaming and feral cats on private property within the City of Clifton. Feeding shall not exceed 30 minutes, either consecutive or cumulative, during each of the three four-hour feeding periods.
FERAL CAT
Any unsocialized cat, whether it was born in the wild or reverted to a wild state due to abandonment or lack of domestication.
FREE-ROAMING CAT
A cat that lives outdoors at least part of the time, including, but not limited to, domesticated cats that are allowed to spend time outdoors, lost or abandoned cats, tame unowned cats and feral cats.
PERSON
Any individual, corporation, company, partnership, firm, association or political subdivision of this state subject to municipal jurisdiction.
No person shall feed, cause to be fed or provide food or water for free-roaming cats and feral cats in the City of Clifton on lands either publicly or privately owned, except that the feeding of free-roaming cats and feral cats is permitted on private property within the City of Clifton, provided that the person performing the feeding:
A. 
Has the permission and authorization of the property owner where the feeding is taking place;
B. 
Places the food or water in a container that must be removed at the end of each feeding period;
C. 
Is physically present on the property where the feeding is taking place for the entire feeding period to avoid the feeding of other unconfined wildlife; and
D. 
Only feed during the prescribed feeding periods.
A. 
The provisions of this article shall be enforced by the Police Department and the Health Department of the City of Clifton.
B. 
Any person found to be in violation of this article shall be ordered to cease the feeding immediately.
Any person who is found to be in violation of the provisions of this article shall be subject to a fine not exceeding $2,000, or imprisonment for a term not exceeding 90 days, or a period of community service not exceeding 90 days.
