As used in this article, the following terms shall have the meanings indicated:
PREMISES
Shall be construed to include an adjacent public parking lot to any shops, stores, grocery markets, self-service stores, or supermarkets in the City.
SHOPPING CART
Any rolling or nonrolling container or basket made of wire, metal, plastic, wood, or other material commonly used in shops, stores, grocery markets, self-service stores, or supermarkets for transporting merchandise and/or food items within the establishments and from the business establishments to a motor vehicle or other building.
No person shall remove a shopping cart from the premises of any shop, store, grocery market, self-service store, supermarket, or other business establishment in the City, regardless of any intention to convert such cart to his or her own use. No person shall use, possess, or abandon a shopping cart that has been taken from a shop, store, grocery market, self-service store, supermarket, or other business establishment, on a street, alley, or other public place in the City.
Any shopping cart found abandoned on a street, alley, or public place in the City may be impounded by the Department of Public Services, the Police Department, or other City department. The Department of Public Services shall then notify the owner that the shopping cart has been abandoned and is being stored at the Department of Public Services. Such shopping carts may be reclaimed by the owner upon payment of a fee as set forth in Chapter 133 of the City of Roseville Code of Ordinances. Any shopping cart not being retrieved for a period greater than 30 days of impoundment, or notice if the owner can be determined, shall be deemed the property of the City of Roseville and disposed of.
A person found in violation of this article shall be guilty of a misdemeanor punishable by 93 days in jail and/or up to a fine of $500.
