Any person who violates this Code by causing or creating any public nuisance or permitting any public nuisance, as defined in Chapter 8.28 of this title, to be created, placed upon or remain upon any premises owned or occupied by him shall, upon conviction thereof, forfeit not less than $500 for a first offense, $750 for a second offense and $2,000 for a third or successive offenses, together with the costs of prosecution. In the event of a failure to pay such forfeiture, where no showing of indigency is made, the defendant may be imprisoned for no more than 90 days, as the court deems fit or until such judgment is sooner paid.
