There is hereby created a Recreation Board in and for the Township of Swatara, Lebanon County, Pennsylvania. The Board shall consist of five persons to be appointed by the Board of Supervisors for such terms as shall permit no more than two terms to expire in any single calendar year. The Board of Supervisors may, at its sole discretion, appoint one ex-officio member to the Recreation Board. Any ex-officio member shall serve in accordance with the terms of all other Recreation Board members but may not vote on any matters before the Recreation Board.

The members of the Recreation Board shall be appointed by the Board of Supervisors for terms of five years, in such order that at least one but not more than two members' terms shall expire annually. The aforesaid appointments for a specified term notwithstanding, a Recreation Board member shall remain in office until a successor is appointed. If a vacancy occurs other than by expiration of a term, the Board of Supervisors shall appointment a person to fill the remainder of the unexpired term. The Board of Supervisors may remove any member of the Recreation Board for dereliction or neglect of duty.

The members of the Recreation Board shall serve without pay but may be reimbursed by the Township for all expenses incurred in performing their duties.

The members of the Recreation Board shall elect, on an annual basis, a chairman, secretary, and any other officers deemed necessary, to serve for a period of one year.

The Recreation Board shall exercise the authority over any recreation facility located within the Township or program serving the residents of the Township, now existing or acquired hereinafter, unless otherwise specified by the Board of Supervisors. The Recreation Board may adopt rules and regulations for the conduct of all business within its jurisdiction.

The Recreation Board shall submit an annual report to the Board of Supervisors, including an analysis of the adequacy and effectiveness of community recreation areas, facilities and leadership. The Recreation Board shall annually submit for approval to the Board of Supervisors a proposed budget for the ensuing year, setting forth all proposed expenditures, salaries and programs. The Recreation Board shall not obligate the Township for the payment of any Township funds unless approved and appropriated by the Board of Supervisors.

This Township shall enter into an inter-governmental agreement with Bethel Township, East Hanover Township, Jonestown Borough, Northern Lebanon School District, and Union Township, all of Lebanon County, to establish the Northern Lebanon Recreation and Parks Commission, as that agreement is stated in the Intergovernmental Agreement of Cooperation that is attached hereto, incorporated herein by reference, and marked Exhibit A.

The Chairman and Secretary of this Township are authorized to sign the Intergovernmental Agreement of Cooperation on behalf of the Board of Supervisors of Swatara Township.
3. 
The Intergovernmental Agreement of Cooperation shall become binding and in force upon the effective date of the ordinance or resolution of the last of the participating local governments to enact or adopt its ordinance or resolution.

The conditions of the Intergovernmental Agreement of Cooperation are set forth in Exhibit A.

The duration of the Intergovernmental Agreement of Cooperation shall be for a period of not less than five years and for an indefinite period thereafter, with the right of any participant to withdraw from the agreement as provided in paragraphs 9(a) and 9(b) of Exhibit A.

The purpose and objectives of the Intergovernmental Agreement of Cooperation and the powers and scope of authority delegated by that agreement are set forth in the recitals and paragraph 3 of Exhibit A.

The manner and extent of financing the Intergovernmental Agreement of Cooperation are set forth in paragraphs 4, 5, 7, and 8 of Exhibit A.

The organizational structure necessary to implement the Intergovernmental Agreement of Cooperation is set forth in paragraphs 2 and 3 of Exhibit A.

The manner in which real or personal property shall be acquired, managed, licensed, or disposed of under the Intergovernmental Agreement of Cooperation is set forth in paragraph 5 of Exhibit A.
10. 
The Northern Lebanon Recreation and Parks Commission created by the Intergovernmental Agreement of Cooperation shall be empowered to enter into contracts for policies of group insurance and employee benefits, including social security, for its employees.
