The Township of Swatara hereby adopts in its entirety the International
Property Maintenance Code of 2012, as may be amended or revised and
as published by the International Code Council, for the regulation
of buildings and structures as therein provided, and each and all
of the provisions of said International Property Maintenance Code
are hereby referred to, adopted, and made a part hereof as though
fully set forth in this Part.

The Board of Appeals described by the International Property
Maintenance Code of 2012, as may be amended or revised, including
its membership and procedures, shall be established from time to time
by resolution by the Board of Supervisors of the Township of Swatara,
and any party appealing to the Board of Appeals a decision by the
Enforcement Officer, shall pay to the Township of Swatara such fees
and costs as are determined by the Township of Swatara by resolution.
The person or persons designated to act as Enforcement Officer for
the Township of Swatara with respect to the International Property
Maintenance Code shall be established from time to time by resolution
of the Board of Supervisors of the Township of Swatara. Penalties
for violation of the International Property Maintenance Code shall
also be established from time to time by resolution of the Board of
Supervisors of the Township of Swatara. No penalties herein shall
prevent the Township from enforcing this Part by equitable, injunctive
and other remedies.

In all matters that are regulated by the laws of the Commonwealth
of Pennsylvania, or by regulations of departments or agencies of the
Commonwealth of Pennsylvania promulgated by authority of law, such
laws or regulations shall control where the requirements thereof are
the same as or in excess of the provisions of this Part. In all matters
that are regulated by other ordinances of the Township of Swatara,
such ordinances shall control where the requirements thereof are the
same as or in excess of the provisions of this Part. This Part shall
control in all cases where there are state requirements or the requirements
of other ordinances of the Township of Swatara are not as strict as
those contained in this Part.

The provisions of this Part, so far as they are the same as
those of ordinances and/or other codes in force immediately prior
to the enactment of this Part, are intended as a continuation of such
ordinances and/or codes, and not as a new enactment. The provisions
of this Part shall not affect any act done or liability incurred,
nor shall they affect any suit or prosecution pending, or to be instituted
to enforce any right or penalty or to punish any offense under the
authority of any of the repealed ordinances.
