1. 
Any park and recreation facilities established, maintained and operated by Swatara Township, Lebanon County, Pennsylvania, shall be open to all members of the public irrespective of race, sex, national origin, color, creed, sexual orientation, or religion.
2. 
Any park and recreational facilities shall be open to the public from dawn to dusk each day unless different hours are established by general or specific notification made by Swatara Township.
3. 
Any section or part of the park or recreation facilities may be declared closed to the public by the Township at any time and for any interval of time, either temporarily or at regular stated intervals for certain uses or maintenance, as the Township shall deem necessary.

1. 
No person shall:
A. 
Park a vehicle in the park or recreation facilities between dusk and dawn.
B. 
Operate and stop, stand or park such vehicles upon any roadway or in any parking area in such a manner as to form an obstruction to traffic thereon.
C. 
Drive upon or park upon any lawn or grassy area in the park or on recreation facilities unless specifically authorized by the Township.
D. 
Operate and stop, stand or park any vehicle in such a manner as to obstruct, block or prohibit use of any maintenance road or walking trail.
E. 
Park in any place where no parking signs have been erected.
F. 
Park in any area designed or designated for handicapped parking without the appropriate handicapped placard.
G. 
Operate a motor vehicle in excess of 15 miles per hour unless a higher rate of speed has been posted.
H. 
Operate a motor vehicle in any park other then park roadways open to and regularly traveled by the general public except vehicles authorized by the Township for the purpose of park and recreation facilities maintenance, improvement, or patrol, or to areas set aside as special use areas.
I. 
Operate any type of mini bike, trail bike, all terrain vehicle, snowmobile, or motorized or battery operated recreational vehicle for riding purposes over 85 pounds weight class or any such vehicle which is not or cannot be registered for operation on the public highways.
J. 
Wash or make mechanical repairs on vehicles except in cases of emergency.
K. 
In conjunction with this section, the Motor Vehicle Code of Pennsylvania, as amended, shall apply to all park and recreation facility roadways.

No person shall ride or lead a horse or pony upon any park or recreation facility.

1. 
No person shall:
A. 
Climb upon, remove, or in any way injure any statue, fountain, wall, bench, banister, ledge, fence, balustrade, railing, pavilion or other structure or play on wet grounds in a manner injurious to turf.
B. 
Tamper with drinking fountains, hydrants, or other water system facilities.
C. 
Fly model powered planes or rockets.
D. 
Gamble in any form without a valid permit.
E. 
Tamper, mar, remove or destroy any official or public sign.
F. 
Pour or cause to spill or permit to escape any oil, gas, salt, acid, or other deleterious substance whether liquid, solid or gaseous, except pursuant to the provisions of an official permit.
G. 
No person shall damage any park or recreation facility building, structure or equipment.
H. 
Bring any waste paper, sweeping, ashes, household waste, glass, metal, refuse or rubbish or any dangerous or detrimental substance into a park or on a recreation facility and deposit the same, either in a receptacle or any other place. This does not prohibit trash or waste generated in the park or recreation facility from a picnic or similar activity to be put into receptacles supplied for that purpose.
I. 
Deposit any bodily waste in or on any portion of any comfort station or other public structure in the park or recreation facility area except directly into such particular fixtures as may be provided for that purpose and not place any bottle, can, rag, metal, wood, or stone substance in any of the plumbing fixtures in such station or structure.
J. 
Cut, deface, mar, destroy, break, or write on or scratch any wall, floor, ceiling, partition, fixture, or furniture, or use towels in any improper manner or waste soap, toilet paper, or any of the facilities provided in a comfort station or other public structure.
K. 
Play ball, golf, pitch horseshoes, engage in archery, camp, engage in finding buried objects with special detectors, or participate in any other form of recreation, sporting endeavor or pastime, except in those areas which may be designated for such purpose.

No person shall cut, remove or destroy any live tree, sapling, seedling, bush or shrub, or chip, blaze, box girdle, trim or otherwise deface or injure any tree or shrub, or break or remove any branch, foliage, tree or shrub, or pick, gather, uproot, remove or destroy any flower, plant of grass except with permit issued by the Township.

No person shall hitch, tie, fasten, nail, anchor, screw, or otherwise attach any wire, cable, chain, rope, card, sign, poster, advertisement, notice, announcement, handbill, board, or other articles or device to any post, tree, shrub, or building, without prior written consent of the Township.

No person shall bring onto the premises, possess, or consume any alcoholic beverage or illegal drugs or substances of any kind, enter any park or recreation facility in an intoxicated state or otherwise be under the influence of alcohol or illegal drugs or substances.

1. 
No person shall:
A. 
Engage in any violent, abusive, loud, boisterous, vulgar, lewd, wanton, obscene or otherwise disorderly conduct tending to create a breach of peace, or to disturb or annoy others.
B. 
Commit any indecent or immoral act tending to debauch the morals or manners of the public.

No person shall peddle or solicit business of any nature whatsoever or collect any funds for any service or charity, or distribute handbills or other advertising matter or materials without prior written consent of the Township.

No person shall:
A. 
Use a loudspeaker, public address system or amplifier within any park or recreation facility without prior written consent of the Township.
B. 
Play or cause to play any radio, television, or any other audio device in a loud or boisterous manner which tends to disturb or annoy any visitor.

1. 
No person shall:
A. 
Smoke in any park or on recreation facility except at designated locations.
B. 
Set or cause to set on fire any trees, woodland, brush, grassland or meadows.
C. 
Build any fire except within fireplaces, receptacles or open spaces approved and designated by the Township.
D. 
Drop, dump, throw or otherwise scatter lighted matches, ashes, burning cigars, cigarettes, tobacco paper or other flammable material.

The cutting of standing trees and shrubs is prohibited.

1. 
No person shall:
A. 
Pursue, catch, attempt to catch, strike, molest, wound, or kill any bird, animal or reptile or any nest, lair, den, burrow or the like of any animal in any park or recreation facility.
B. 
Fish or trap except in accordance with the laws of the Commonwealth of Pennsylvania and as authorized by the Township.
C. 
Drive or pursue any wild bird or animal from the confines of any park or recreation facility.

Hunting and trapping is prohibited unless posted or designated otherwise.

Pets are permitted provided they are on a leash not exceeding six feet in length and attended at all times and must be controlled to the extent that they will not cause injury to any person, another person's property or molest or injure wildlife. The owner or handler of any dog or animal shall immediately clean up and properly dispose of any dog or animal feces. The controlled training of unleashed dogs or animals is permitted in designated areas.

No person shall:
A. 
Enter the property from dusk to dawn each day unless different hours are established by general or specific notification made by Swatara Township.
B. 
Enter upon any grounds that have been posted by the Township with no trespassing or special wildlife signs or any sign that would indicate that the area is not open to the general public without first obtaining express permission from the Township.
C. 
Enter any building that is not open to and regularly used by the public.
D. 
Enter upon or disturb construction or equipment on any park or recreation facility property except authorized personnel.

No person shall force, threaten, intimidate, fence, enclose, or by any other means, prevent or obstruct any person from entering, leaving or making full use of any park or recreation facilities unless under the jurisdiction of the Township consistent with the terms of this Part and other applicable statutes, rules and regulations, and then only by persons authorized to do so by the Township.

No person shall interfere with, use profanity towards, or in any manner hinder any employee or agent of the Township who are performing their official duties within any park or recreation facility.

No person shall bring into or upon any park or recreation facility, nor have in his or her possession, or discharge, or set off anywhere upon any park or recreation facility any firearm, air gun, bow, or other weapon that discharges projectiles either by air, explosive substance or by any other force.

Play on any athletic field is prohibited during wet or inclement weather.

This Part shall be enforced by the Swatara Township Code Enforcement Officer, or by any other person designated, subsequent to the enactment of this Part, by resolution adopted in public session by the Board of Supervisors.
2. 
The Township Code Enforcement Officer is authorized to perform all duties necessary and appropriate to be performed in the view of the Township related to this Part, including, but not limited to, making all necessary inspections, and enforcement of violations and penalties.

Any person who violates any provision of this Part shall be subject to civil enforcement and a fine not to exceed $600 per violation and/or criminal enforcement, as a summary offense, with a criminal fine not to exceed $1,000 per violation and imprisonment not to exceed 30 days. Each day that a violation of this Part continues to exist shall constitute a separate offense. Such civil enforcement, criminal enforcement, and fines shall be in accordance with provisions of 53 P.S. § 66601, as amended.
