No person or corporation shall excavate or remove gravel or soil for sale or use other than on the premises, except in connection with construction, without obtaining permission from the Mayor and Common Council of the City of Corbin City.
Application for such permission shall be made to the Common Council, together with a contour map of the premises and proposed contour grades resulting.
No such permission shall be given without due consideration to the public health, safety and general welfare of the community and, more particularly, soil erosion, drainage, soil fertility, lateral support, slopes and grades, land values and uses and the overall effect on the general purpose of municipal planning.
Any person or corporation attempting to remove gravel or soil from any premises within Corbin City without a permit shall be subject to a fine not to exceed $500 or a penalty of imprisonment not to exceed 90 days, or both. Each twenty-four-hour period of said violation shall be deemed to be a separate offense and punishable as aforesaid by said fine or imprisonment, or both.
