The Borough of Folcroft does hereby signify intention to organize an authority together with the Townships of Ridley, Springfield and Upper Darby, and the Boroughs of Clifton Heights, Glenolden and Norwood, under the provisions of the Acts of Assembly and the amendments and supplements thereto.
The proper officers are hereby authorized and directed to organize said Authority in conjunction with the proper officers of the aforesaid townships and boroughs, and together with the aforesaid officers, to execute the Articles of Incorporation and to file the same with the Secretary of the Commonwealth of Pennsylvania, as provided by law.
A. 
Said Articles of Incorporation shall be as follows:
(1) 
The name of the authority shall be: "Muckinipates Authority."
(2) 
The authority is formed under the provisions of the Acts of Pennsylvania, No. 191, Sessions of 1935, and No. 200 of the Session of 1937.[1]

(3) 
That no other authority organized under the Municipal Authority Act of 1937 (Act No. 200), nor under the Act approved December 27, 1933 (Special Session 1933, P.L. 114),[2] is in existence in or for the incorporating municipalities.

(4) 
The names of the incorporating municipalities, together with the names and addresses of its municipal officers, are as follows: [Here followed the names and ordinances of the officials of the incorporating municipalities].
(5) 
The names and addresses and terms of office of the first members of the Board of said Authority are as follows: [Here followed the names and addresses of the first members of the Board].
(6) 
Commissioners or councils, as the case may be, of each municipality creating said joint authority shall appoint one member of the Board.
B. 
The Borough of Glenolden and the Township of Ridley shall appoint one member each for a period of four years from the first of January 1939. The Township of Springfield and the Borough of Norwood for a period of three years from the first of January 1939. The Township of Upper Darby and the Borough of Folcroft for a period of two years from the first of January 1939, and the Borough of Clifton Heights for period of one year from the first of January 1939, all said terms to start immediately upon the granting of Certificate of Incorporation by the Secretary of the Commonwealth. Thereafter, said Commissioners or Council, as the case may be, shall at a meeting held not later than one month prior to January 1, in each year in which a vacancy occurs in the office filled by that municipality, appoint as a member of the Board, a citizen of that municipality, for a term of four years to succeed the member whose term expires on January 1 next succeeding.
C. 
All vacancies shall be filled by the governing body of the municipality whose appointee has vacated his office.

The Borough of Folcroft does hereby signify its desire of becoming a member of the Darby Creek Joint Authority, a joint municipal authority heretofore created by the Townships of Springfield and Upper Darby and the Boroughs of Aldan, Clifton Heights, Collingdale, Colwyne, Darby, Lansdowne, Sharon Hill and Yeadon, with charter issued by the Secretary of the Commonwealth of Pennsylvania, dated August 2, 1938, and existing under the provisions of the Acts of Assembly and amendments and supplements thereto.
The Borough of Folcroft does hereby signify its approval of the application of the Township of Darby to become a member of the Darby Creek Joint Authority.
The proper officers are hereby authorized and directed to make application to said Authority to become a member thereof; to advertise this article as required by law; to take all needful and proper steps to accomplish the desire herein expressed; and together with the proper officers of the Township of Darby, the proper officers of said Authority and the proper officers of said townships and boroughs which are now members of said Authority, to execute the Articles of Joinder and to file the same with the Secretary of the Commonwealth of Pennsylvania as provided by law.

Said Articles of Joinder shall be as follows:
A. 
The name of the Authority is: "Darby Creek Joint Authority."
B. 
The Authority was formed under the provisions of the Acts of Pennsylvania, No. 191 of the Session of 1935, and No. 200 of the Session of 1937,[1] with Charter issued dated August 2, 1938, and recorded in the Office for the Recording of Deeds in and for the County of Delaware in Charter Book "I," page 342.

C. 
The present members of said Joint Authority are the Townships of Springfield and Upper Darby and the Boroughs of Aldan, Clifton Heights, Collingdale, Colwyn, Darby, Lansdowne, Sharon Hill and Yeadon, all municipalities of the County of Delaware, Pennsylvania.
D. 
That there are in existence in or for one or more of said municipalities and other municipalities not composing this group joint authorities organized pursuant to said acts as follows:
(1) 
Muckinipates Authority, whose municipalities are as follows:
(a) 
Township of Ridley.
(b) 
Township of Springfield.
(c) 
Township of Upper Darby.
(d) 
Borough of Clifton Heights.
(e) 
Borough of Folcroft.
(f) 
Borough of Glenolden.
(g) 
Borough of Norwood.
(2) 
Central Delaware County Authority, whose member municipalities are as follows:
(a) 
Township of Nether Providence.
(b) 
Township of Ridley.
(c) 
Township of Springfield.
(d) 
Borough of Morton.
(e) 
Borough of Prospect Park.
(f) 
Borough of Ridley Park.
(g) 
Borough of Rutledge.
(h) 
Borough of Swarthmore.
E. 
The name of the municipalities seeking to become members of the Authority with the same names and addresses of their municipal officers are as follows: [Here followed the names and addresses of the officials of the incorporating municipalities].
F. 
The names, addresses and terms of office of the first members of the Board of said Authority from said municipalities seeking to become members are as follows: [Here followed the names and addresses of the first members of the Board].
G. 
Commissioners or Council, as the case may be, of each municipality seeking to become a member of said Joint Authority shall appoint one member of the Board to serve for the term of five years, and thereafter said Commissioners or Council, as the case may be, shall at a meeting held not later that one month prior to January 1 in each year in which a vacancy occurs in the office filled by that municipality, shall appoint as a member of the Board, a citizen of the municipality for a term of five years to succeed the member whose term expires on January 1 next succeeding. All vacancies shall be filled by the governing body of the municipality whose appointee has vacated his office.

The term of existence shall be to a date not exceeding 50 years from the date of approval of the Articles of Amendment.
