The Town of Arbor Vitae, Vilas County, State of Wisconsin, does ordain as follows: There is hereby established a Town Plan Commission for the Town of Arbor Vitae, Vilas County, Wisconsin in accordance with §§ 60.10(2)(c) and 60.22(3) of Wisconsin Statutes, for the purpose of review and recommendation to the Arbor Vitae Town Board of Supervisors.
A. 
The Town Plan Commission shall consist of seven members who shall serve without compensation. One member shall be the Town Chairman. One member shall be a Supervisor, elected for a term of two years by a majority vote of the Town Board in May of every other year. The other members shall be citizen members, of recognized experience and qualifications, appointed by the Town Chairman, subject to confirmation by the Town Board. Chairman shall be the Town Chairman. An eighth member shall be appointed as an alternate member and shall serve in the absence or tardiness of any regular commission member and shall have full voting powers for the duration of such meeting.

B. 
Secretary shall be appointed by the Chairman.
C. 
Official oaths shall be taken by all members, in accordance with § 19.01 of the Wisconsin Statutes, within 10 days of receiving notice of their appointments.
D. 
Terms for all citizen members shall commence in the first week of May, and each term shall be staggered and each term shall be for a three-year period.
A. 
The Plan Commission shall organize and adopt rules for its own government in accordance with the provisions of this chapter and specific directives of the Arbor Vitae Town Board of Supervisors.
B. 
Meetings shall be held monthly and at the call of the Chairman or a majority of the full membership of the Commission and shall be open to the public.
C. 
Special and Standing Committees may be appointed by the Chairman.
D. 
Quorum shall be four members, but all actions shall require the approval of the majority of the full Commission, except to adjourn.
E. 
A written record shall be kept showing all the actions taken, resolutions, determinations, transactions and recommendations made; and a copy shall be filed with the Town Clerk as a public record.
The Plan Commission shall have such powers as may be necessary to enable it to perform its functions and duties and promote municipal planning. Such powers include the following:
A. 
To employ experts and to pay for their services and such expenses as may be necessary and proper, not to exceed appropriations and regulations made by the Town Board.
B. 
To make reports and recommendations relating to the plan and development of the municipality to public officials, agencies, utilities and other organizations and citizens.
C. 
To recommend public improvement programs and financing thereof to the Town Board.
D. 
To request available information from any public official to be furnished within a reasonable period of time.
E. 
To enter upon any land. The Plan Commission members may only enter lands for which the property owners or agents are seeking a permit, variance or other inspections, or for which the property owner or agent is requesting approvals for specific items of Plan Commission business or under authorization of a court order issued by a court of competent jurisdiction. In all other cases, permission must be granted by the property owner or agent.
The Plan Commission shall have the following functions and duties:
A. 
To create a suitable and accurate land use plan and amendment recommendations to the Arbor Vitae Town Board of Supervisors for further recommendation and adoption by the Vilas County Board of Supervisors.
B. 
To prepare and recommend land division regulations to the Town Board in accordance with § 236.45 of the Wisconsin Statutes.
C. 
To make changes to the Land Use Plan they deem necessary or desirable and to recommend any changes or amendments to the Town Board that they deem necessary or desirable concerning the Official Map, Zoning and Land Division Ordinances.
D. 
To implement the design review process for commercial, industrial and multifamily development as specified under Ordinance No. 1-96 of the Town of Arbor Vitae.[1] To consider and report and recommend on all matters referred to them.

The Town Board or other public body or officer of the Town of Arbor Vitae having final authority thereon shall refer to the Plan Commission for its consideration and report before final action is taken in the following matters:
A. 
Location and architectural design of any public building.
B. 
Location of any statue or other memorial, excepting the grounds of Sunset Memorial Gardens Municipal Cemetery, regulated by the Cemetery Commission.
C. 
Location, extension, abandonment, alteration, vacation, change of use, sale, acquisition or lease of land for any street, alley or other public way, park, playground, airport, parking area or other memorial or public grounds.
D. 
Location, acceptance, extension, abandonment or authorization for any public utility whether publicly or privately owned.
E. 
Location, character and extent, or acquisition, leasing or sale of lands for public or semi-public housing, slum clearance, relief of congestion or vacation camps for children. Proposed fire prevention regulations. All annexations, incorporations or consolidations affecting the Town of Arbor Vitae, including, but not limited to, financial impact statements for proposed changes, where public funding will be expended.
F. 
All proposed or requested changes and amendments to the Land Use Plan, Official Map, Zoning or Land Division Ordinances.
The Plan Commission shall have all the additional powers and duties granted or assigned by the Town Board or by Town ordinances and all the powers and duties granted or assigned to towns exercising Village powers under Wisconsin Statutes.
If any section or part of this chapter is adjudged unconstitutional or invalid by a court of competent jurisdiction, the remainder of this chapter shall not be affected thereby. All other ordinances or parts of ordinances of the Town of Arbor Vitae inconsistent with this chapter, to the extent of the inconsistency only, are hereby repealed.
