The Town Board of the Town of Blooming Grove hereby finds and determines that it is in the best interest of the residents of Blooming Grove to find and appoint qualified people to Town offices, including the office of the Receiver of Taxes and Assessments. The Town Board also finds that the requirement that the First and Second Deputy Receivers of Taxes and Assessments be Town residents and electors may limit the Board's ability to find qualified people to fill that position. Therefore, the Town Board hereby determines that the residency requirement for appointment to the position of First and Second Deputy Receivers of Taxes and Assessments should include residents of the County of Orange, State of New York.
The First and Second Deputy Receivers of Taxes and Assessments shall reside in the County of Orange, State of New York. There shall be no requirement that the First and Second Deputy Receivers of Taxes and Assessments reside in the Town of Blooming Grove and be an elector of the Town.
This article is adopted pursuant to § 10 of the Municipal Home Rule Law and is intended to supersede New York State Public Officers Law § 3 and any other special law to the extent that such special law may require the First and Second Deputy Receivers of Taxes and Assessments to reside within the Town of Blooming Grove and be electors of the Town.
