If there shall be any payments which are due to the City of Port Jervis and/or the Building Department thereof, pursuant to any article or section of the Port Jervis City Code, including fees, penalties or fines due under Chapter 231 of the Code, which shall remain due and unpaid, in whole or in part, for a period of 20 calendar days from the date of billing by the City of Port Jervis, or 20 calendar days from the date of any court order to pay same, the same shall constitute a default and there shall be added to the entire amount of the original bill a penalty equal to 5% per month of the original bill, retroactive to the date of the original billing. The Building Official of the City of Port Jervis shall keep a record of these delinquent/unpaid fees, penalties and fines and report same to the City Clerk-Treasurer and the Corporation Counsel of the City of Port Jervis after said twenty-day period has expired.
In the event that there are any Building Department fees, penalties or fines or other service charges which shall have been delinquent for a period of at least 45 calendar days as of December 15 of any year as described in this section, the City Clerk-Treasurer shall report the names of the defaulting persons to the City of Port Jervis, Common Council and the Mayor, on or before December 15 of the same year. The City of Port Jervis City Clerk-Treasurer is hereby directed to add the entire amount of the Building Department fees, penalties or fines or other service charges which shall be in default, plus penalties and interest, as provided for in this article, to the real property taxes due and owing to the City of Port Jervis in the next succeeding year, and the City of Port Jervis City Clerk-Treasurer is directed to collect same in the same manner as real property taxes due and owing to the City of Port Jervis are collected.
Where charges are delinquent and the violator is not a resident of the City of Port Jervis or is located outside the geographical boundaries of the City of Port Jervis, then the Corporation Counsel of the City of Port Jervis is authorized to seek recovery of charges, including punitive damages, in a court of competent jurisdiction.
