The Borough of Larksville hereby adopts, for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion, the fire prevention code known as the "BOCA National Fire Prevention Code, 1996, 10th Edition," as published by the Building Officials and Code Administrators International, Inc., and any future editions, save and except such portions as are hereinafter deleted, modified or amended, of which three copies have been and are now filed in the office of the Borough Secretary, and the same are hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this chapter shall take effect, the provisions thereof shall be controlling within the corporate limits of the Borough.
The fire prevention code hereby adopted is amended as follows:
A. 
Section F-101.1, Title, is amended to read:
Section F-101.1 Title: These regulations shall be known as the "Fire Prevention Code of the Borough of Larksville," hereafter referred to as "this Code."
B. 
Section F-112.3, Penalty for Violations, is amended to read:
Section F-112.3 Penalty for violations: Any person who shall violate any of the provisions of this code or fail to comply with any order issued pursuant to any section hereof, shall be, upon conviction thereof, sentenced to a fine of not less than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation continues after due notice has been served shall be deemed a separate offense.
In all matters that are regulated by the laws of the Commonwealth of Pennsylvania or by regulations of departments or agencies of the commonwealth promulgated by authority of law, such laws or regulations, or other ordinances of the Borough of Larksville, as the case may be, shall control where the requirements thereof are the same as or in excess of the provisions of this chapter. The code shall control in all cases where the state requirements, or the requirements of other ordinances of this Borough, are not as strict as those contained in this chapter.
The provisions of this chapter so far as they are the same as those of ordinances and/or codes enforced immediately prior to the enactment of this chapter, are intended as a continuation of such ordinances and/or codes and not as new enactments. The provisions of this chapter shall not affect any act done or liability incurred, nor shall they affect any suit or prosecution impending or to be instituted to enforce any right of penalty or to punish any offense under the authority of any other repealed ordinances.
