These regulations shall be known as the "Mechanical Code of
the City of Kennett, Missouri," also referred to in said regulations
as "this code."

Subject to the provisions hereinafter set forth, a certain document,
a copy of which is on file in the office of the City Clerk of Kennett,
Missouri, being marked as the International Mechanical Code, 2012
Edition, as published by the International Code Council, be and is
hereby adopted as the mechanical code of the City of Kennett, Missouri,
for the control of buildings and structures as herein provided; and
each and all of the regulations, provisions, penalties, conditions
and terms of the International Mechanical Code, 2012 Edition, are
hereby referred to, adopted and made a part hereof, as if fully set
out in this Article.

Wherever the title "Mechanical Officer" is used in said Code,
the same shall be construed to mean the Code Enforcement/Property
Maintenance Officer of the City of Kennett, Missouri.

The provisions of this code shall not operate or affect any
permits or approvals heretofore created.

The fees for inspections and permits shall be the same as specified in Section
500.120 of this Title. The Code Enforcement/Property Maintenance Officer is authorized to establish other fees for inspections and permits which are not covered under said Section.

Any person, firm or corporation who shall violate a provision
of this code or shall fail to comply with any of the requirements
thereto or who shall install mechanical work in violation of an approved
plan or directive of the Code Enforcement/Property Maintenance Officer
or of a permit or certificate issued under the provisions of this
code, shall be subject to a fine of not less than one dollar ($1.00),
nor more than five hundred dollars ($500.00), or by imprisonment not
exceeding ninety (90) days, or both such fine and imprisonment. Each
day during which a violation continues shall be deemed a separate
offense.

Any person who shall continue any mechanical work after having
been served with a stop-work order, except such work as he/she is
directed to perform to remove a violation or unsafe conditions, shall
be liable to a fine of not less than one dollar ($1.00), nor more
than five hundred dollars ($500.00).

Nothing in this Article or in the mechanical code hereby adopted
shall be construed to affect any suit or proceeding pending in any
court, or any rights acquired, or liability incurred, or any cause
or causes of action acquired or existing, under any act or ordinance
hereby repealed, nor shall any just or legal right or remedy of any
character be lost, impaired, or affected by this Article.

A. The installation and use of unvented gas heaters shall be permitted
in the City limits of the City of Kennett, Missouri. Any such heater
shall contain an oxygen deficiency sensor safety pilot and shall be
approved for use without ventilation.
B. The uses permitted in Subsection
(A) of this Section as a primary heat source shall be limited to commercial businesses in non-sleeping areas, and may only be used in residences only as a secondary heat source and only in areas in the residence which are not used as sleeping quarters. All heaters are required to meet the National Safety Standards of the American Gas Association, subject to the above exceptions, all other requirements and standards of the currently adopted international mechanical and building codes with all applicable amendments thereto.
