The provisions of this chapter shall apply to all property within
the City of Pawtucket. All public and private exterior lighting installed
in the City of Pawtucket shall be in conformance with the requirements
established by this chapter.
This chapter serves to protect the health, safety, and welfare
of the citizens of Pawtucket by regulating the intensity and design
of exterior artificial light that may adversely impact residential
properties.
A.Â
Any exterior lighting fixture used to illuminate any building, structure,
improvement, parking area, or parcel of land shall be so arranged
as not to direct light onto any adjacent street or parcel used for
residential purposes.
B.Â
No exterior lighting fixture shall be used unless reflectors and/or
lenses are fitted to concentrate illumination upon the desired area
and shield adjacent streets or parcels used for residential purposes
from direct glare as to minimize impact.
C.Â
Exterior lighting used to illuminate outdoor activity, driveway,
or parking areas shall be so arranged and shaded as to reflect away
from adjacent streets or parcels used for residential purposes.
D.Â
All temporary exterior lighting used for utility improvements, emergency
services, or hazard warning shall be exempted from the provisions
of this chapter.
The provisions of this chapter shall be enforced by the Pawtucket
Police Department and the Pawtucket Zoning Department. Notice of noncompliance
with any of the provisions of this chapter shall be provided in writing
to the property owner of record on which the noncompliant exterior
lighting fixture is located.
Any property owner who receives a notice of noncompliance for
any violation of this chapter shall have 20 days to correct the violation.
A failure to correct the violation within 20 days shall result in
the imposition of a fine of $50. A fine in the amount of $100 shall
be imposed for a second violation of this chapter. A fine in the amount
of $250 shall be imposed for a third or subsequent violation of this
chapter.
