PERSON
Any natural person, association, partnership, firm or corporation.
SOLICITING OR CANVASSING
Engaging in seeking information or soliciting donations by calling at residences without the previous consent of the occupant or by standing on or patrolling the public areas of the Borough.
SOLICITOR OR CANVASSER
Any person who shall be engaged in soliciting or canvassing.
In this Part, the singular shall include the plural and the masculine shall include the feminine and the neuter.

It shall be unlawful for any person to engage in business as a canvasser or solicitor, calling at residences without the previous consent of the occupant or standing on or patrolling the streets or sidewalks of the Borough for the purpose of soliciting or seeking information or donations without first having registered with the Chief of Police as herein provided.

Each applicant for registration shall give his name; permanent address; his previous criminal record, if any; the name of the person or organization he is representing; the length of time he wishes to engage as a canvasser or solicitor; the number of helpers he has; and the proposed method of operation in the Borough. Provided, where a person makes application for himself and one or more helpers, all applicable personal information specified above shall be given for each helper and an individual certificate shall be required for each helper. No certificate issued shall be transferable from one person to another.

Each registrant shall pay to the Chief of Police a registration fee in an amount as established, from time to time, by resolution of the Borough Council for the period expiring seven days after the date of said registration.

Each applicant who shows evidence of good character and who pays the fees provided for herein shall be furnished a certificate indicating that he or she has registered and showing the dates covered by such registration.

Each person shall at all times while soliciting or canvassing in the Borough carry upon hie person the registration certificate and the same shall be exhibited by such registrant whenever he is required to do so by any police officer or by any person solicited.

No person registered under this Part shall engage in soliciting or canvassing at any time on Sunday or on any other day of the week before 9:00 a.m. or after 5:00 p.m.

The provisions of this Part shall not apply to officers or employees of the Borough, county, state or federal government, or any subdivision thereof, when an official business nor to any nonprofit organization which maintains an office, place or business or meeting room in the Borough; nor to collections of a charitable or benevolent nature for the benefit of residents of the Borough or the families of deceased residents.

Any such registration may be revoked by the Mayor or the Chief of Police because of any violation by the registrant of this Part or of any other ordinance of the Borough, or of any state or federal law, or whenever the registrant shall cease to posses the qualifications and character required in this Part for the original registration.

Any person, firm or corporation who shall violate any provision of this Part, upon conviction thereof in an action brought before a magisterial district judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not less than $25 nor more than $1,000 plus costs together with reasonable attorney fees and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each section of this Part which shall be found to have been violated shall constitute a separate offense.
