No person, firm or corporation owning or occupying any property
within the Borough of Springdale shall permit any grass or weeds,
poison oak, poison ivy, or any vegetation whatsoever, not edible or
planted for some useful or ornamental purpose, to grow or remain upon
such premises so as to exceed a height of six inches, or to throw
off any unpleasant or noxious odor, or to conceal any filthy deposit
or to create or produce pollen. Any grass, weeds, poison oak, poison
ivy, or other vegetation growing upon any premises in the Borough
in violation of any of the provisions of this section is hereby declared
to be a nuisance and detrimental to the health, welfare, cleanliness,
safety and comfort of the inhabitants of the Borough.

No person, firm or corporation owning or occupying any property
within the Borough of Springdale shall permit any hedge, shrub, or
other such similar growth to grow on his property to a height higher
than a maximum height of 6 1/2 feet along side lot lines or at
corners of lots abutting an intersection in order not to unreasonably
obstruct the view of pedestrians or vehicles using the streets or
intersections of streets in the Borough. Any such hedge, shrub or
growth or other such like vegetation growing upon any premises in
the Borough in violation of any of the provisions of this section
is hereby declared to be a nuisance and detrimental to the health,
safety, and public welfare of the inhabitants of the Borough.
The owner of any premises, as to vacant premises or premises occupied by the owner, and the occupant thereof in case of premises occupied by other than the owner thereof, shall remove, trim or cut all grass, weeds, poison oak, poison ivy, hedges, shrubbery, or other vegetation growing or remaining upon such premises in violation of the provisions of §§ 184-1 and 184-2 of this chapter.
The Council of The Borough of Springdale, or any officer or employee of the Borough designated thereby for the purpose, is hereby authorized to give notice, by personal service by United States Mail, to the owner or occupant, as the case may be, of any premises whereon grass, weeds, poison oak, poison ivy, hedges, shrubbery or other such vegetation is growing, or remaining, in violation of the provisions of §§ 184-1 and 184-2 of this chapter, directing and requiring such occupant to remove, trim or cut such grass, weeds, poison oak, poison ivy, hedge or shrubbery, or other vegetation so as to conform to the requirements of this chapter, within five days after issuance of such notice. In case any person, firm or corporation shall neglect, fail or refuse to comply with such notice within the period of time stated therein, the Borough authorities may remove, trim or cut such grass, weeds, poison oak, poison ivy, hedges or shrubbery, or other such vegetation, and the costs thereof, together with any additional penalty authorized by the law, may be collected by the Borough from such person, firm or corporation in the manner provided by law.

Any person, group, organization or corporation violating any
of the provisions of this chapter shall, upon conviction thereof by
the Magisterial District Judge or other court of competent jurisdiction,
be guilty of a summary offense punishable by a fine of not less than
$300 and not more than $600, together with costs of prosecution and
reasonable attorney fees, provided each day a violation continues
to occur shall be deemed a separate offense subject to the imposition
of a separate fine and no further notice to the offender or separate
citation shall be necessary in order to constitute a separate offense
or fine.

To the extent there is any express conflict with the provisions
of this chapter and the duly adopted International Property Maintenance
Code in effect from time to time, the language set forth in the Property
Maintenance Code shall take precedence and prevail over the language
of this chapter. To the extent any other ordinance or ordinances are
in conflict with the terms of this chapter, same are hereby repealed
to the extent of any such conflict.
