Words and phrases used in this chapter shall have the meanings
ascribed to them in the Vehicle Code of Pennsylvania, Act No. 81 of
1976 (75 Pa.C.S.A. § 101 et seq.), as amended (hereinafter
referred to as "Vehicle Code"), except where the context clearly indicates
a different meaning.
The Borough of Springdale.
The Council of the Borough of Springdale.
The Mayor of the Borough of Springdale.
The Chief of Police of the Borough of Springdale.
Includes any and all state highway routes and roads and all
other highways, streets, alleys, lanes and ways within the Borough.
The provisions of the Vehicle Code shall be used for determination
of all penalties and for enforcement purposes, except as otherwise
provided herein. This chapter is intended to apply to specific highways
and streets which are regulated or restricted in usage. The provisions
of the Vehicle Code shall be used for traffic regulations, speed restrictions
and parking regulations within the Borough, except as otherwise provided
herein.
All traffic and parking regulations of a permanent nature shall
be enacted as ordinances or as parts of ordinances or as amendments
to ordinances of the Borough.
A.
The Mayor shall have the following powers to regulate traffic and
parking temporarily and in time of emergency:
(1)
In the case of flood, storm or other emergency, to establish temporary
traffic and/or parking regulations.
(2)
In the case of emergency or to facilitate public works, or in the
conduct of parades, processions or public events, to restrict or prohibit
traffic and/or parking in limited areas.
(3)
The above regulations shall be effective for periods of not more
than seven days.
B.
Such temporary and emergency regulations shall be enforced by the
Mayor and Police Department in the same manner as permanent regulations.
Any person who shall operate, park or leave standing a vehicle or
tractor in violation of any such regulation, or who shall move, remove,
destroy, injure or deface any sign or marking erected, posted or made
to give notice of any such regulation, shall, upon conviction thereof,
be liable for the penalties set forth in this chapter. Any police
officer of the Borough of Springdale may remove or cause to be removed
to a place of safety any vehicle or tractor which is parked or left
standing in violation of any regulation established pursuant to this
section.
C.
In anticipation of or during any event, including but not limited
to emergencies, which shall occur in the Borough and which shall require
temporary motor vehicle parking regulation, the Mayor is hereby authorized
to designate streets for no parking and to cause no-parking signs
to be erected for such duration as shall be necessary for the efficient
and safe movement of traffic, with the same force and effect as though
this chapter specifically designated the no-parking area.
A.
The Mayor is hereby empowered to make a ninety-day trial of any traffic
regulation, provided that, in advance of its becoming effective, the
Council shall be notified, in writing, of such proposed regulation,
with reasons for it, and provided that notice of such regulation by
signs shall be given to the public in advance of its enforcement.
After the day the said regulation so becomes effective, it shall govern
traffic for a period of 90 days thereafter, within which time there
may be introduced to the Council an ordinance embodying such regulation
or such part thereof as it may be desired to have continued in force,
and such regulation shall continue in force during such time as the
said ordinance shall be pending.
B.
If no ordinance embodying such regulation or any part thereof shall
be introduced to the Council within said period of 90 days, or if
any such ordinance shall fail of final enactment, then such regulation
shall be no longer in force.
C.
The Council may at any time rescind any such trial regulation by
a written resolution presented to the Mayor. Upon receipt of such
resolution, the Mayor shall immediately cause such regulation to be
withdrawn and the regulation which applied prior to it again enforced.
The police officers of the Borough are hereby given authority
to direct traffic on the streets of the Borough and at intersections
thereof and on school property when so requested by the school authorities.
In any conflict between the provisions of this chapter and any
previously adopted ordinance or resolution of the Borough of Springdale,
the provisions of this chapter shall control. The following ordinances
of the Borough of Springdale are hereby repealed in their entirety:
A.
Ordinance No. 692, enacted March 5, 1957, entitled "An ordinance
of the Borough of Springdale, regulating the parking of vehicles on
the streets, alleys and parkways within the limits of the Borough,
whether propelled by human, mechanical, motor, electrical or other
device, including wagons, buggies, motorcycles or other vehicles using
said streets or alleys, providing fines and penalties and a method
of collecting said fines."
B.
Ordinance No. 769, enacted November 22, 1960, entitled "An ordinance
of the Borough of Springdale prescribing traffic and parking regulations
and providing penalties for violation thereof."
C.
Ordinance No. 792, enacted December 19, 1961, entitled "An ordinance
of the Borough of Springdale prescribing rules and regulations for
the operation of the public parking lots in the Borough of Springdale,
and fixing penalties for the violation thereof."
D.
Ordinance No. 902, enacted May 13, 1969, entitled "An ordinance of
the Borough of Springdale, Allegheny County, Pennsylvania, regulating
the parking of motor vehicles on the various streets of the Borough
during street sweeping, setting forth the names of said streets and
the times when parking is prohibited, and prescribing fines and penalties
for violation thereof."
E.
Ordinance No. 1084, enacted October 8, 1985, entitled "An ordinance
of the Borough of Springdale, Allegheny County, Pennsylvania, regulating,
restricting or prohibiting parking on certain Borough streets, said
streets enumerated in the body of this chapter, and providing penalties
for violation thereof."
F.
Ordinance No. 1163, enacted November 16, 1993, entitled "An ordinance
of the Borough of Springdale, designating Murtland Avenue for one-way
traffic only between Elwyn Avenue and Chestnut Street and providing
for erection of official traffic control devices and for enforcement
and penalties.
