As used in this chapter, the following terms shall have the meanings indicated:
CLERK
The Clerk of the Town of Cicero by whom licenses are validated or issued pursuant to this article.
DOG
Any member of the species canis familiaris.
DOG CONTROL OFFICER
The officer appointed by the Town for the purpose of being responsible for the control of dogs and the enforcement of Article II of Chapter 58 of the Town Code.
DOMESTICATED ANIMAL
Any animal which is commonly domesticated in this state, including but not limited to swine, goats, sheep, cows, cats, dogs, and parrots, or any other animal which is lawfully owned and controlled by a person or entity, provided that such person or entity can demonstrate such ownership and control.
DWELLING HOUSE
Any temporary or permanent living quarters for humans.
GARBAGE
Any animal or vegetable waste matter from homes, restaurants, vegetable or fruit markets, and offal from abattoirs and packing houses.
HARBOR
To provide food or shelter to a dog.
HIGHWAY
Any Town, county or state road.
IDENTIFICATION TAG
A tag issued by the licensing municipality which sets forth an identification number, together with the name of the Town, the State of New York, contact information, including telephone number for the Town and such other information as the Town deems appropriate. For the purposes of this chapter, an identification tag containing accurate information identifies a dog to which it is affixed.
MANURE
The excrement from swine.
OWNER
Includes a person who keeps, or has custody, care, or control of an animal. Animals owned by minors shall be deemed to be in the custody of parents or other head of the household where the minor resides. Any person harboring an animal for a period of one week shall be deemed to be the owner of the animal for the purposes of enforcing this chapter.
OWNER OF RECORD
The person in whose name a dog was last licensed pursuant to this chapter or the State of New York (if prior to January 1, 2011), except that if any license is issued on application of a person under 18 years of age, the owner of record shall be deemed to be the parent or guardian of such person. If it cannot be determined in whose name a dog was last licensed or if the owner of record has filed a statement pursuant to the provisions of § 58-14.6 of this chapter, the owner shall be deemed to be the owner of record of such dog, except that if the owner is under 18 years of age, the owner of record shall be deemed to be the parent or guardian of such person.
PREMISES
Land with or without buildings on which swine are kept.
SWINE
Pigs or hogs in excess of eight weeks old.
SWINE OR HOG FARM
Any farm raising swine for sale or exchange.
WILD ANIMAL
Any animal which is not commonly domesticated in this state, including but not limited to bears, coyotes, deer, feral cats, feral swine, foxes, groundhogs, opossums, pigeons, raccoons, skunks, and waterfowl.
