All Village officials and employees are public servants in the sense that they serve the citizens of the Oakwood community. This relationship with the public carries with it a public trust, and part of that trust is that all Village personnel and their work environment should be drug-free and alcohol-free. Henceforth, all Village personnel shall be subject to the following policy provisions.
Pursuant to the federal Drug-Free Workplace Act and the Illinois Drug-Free Workplace Act,[1] the Village of Oakwood shall provide a drug-free workplace by:
A. 
Notifying all personnel that the unlawful manufacture, distribution, dispensing, possession or use of a controlled substance is prohibited in any Village of Oakwood workplace, and specifying the actions that will be taken against any personnel for violation of this prohibition.
B. 
Establishing a drug-free awareness program to inform personnel about:
(1) 
The dangers of drugs in the workplace;
(2) 
Distribution of this policy on maintaining a drug-free workplace;
(3) 
Any available drug counseling, rehabilitation and personnel assistance programs; and
(4) 
The penalties that may be imposed upon personnel for drug abuse violations occurring in the workplace.
C. 
Each employee of the Village of Oakwood will be given a copy of this policy.
D. 
Each person will be notified that as a condition of employment with the Village of Oakwood the personnel will:
(1) 
Abide by the terms of the policy; and
(2) 
Notify the Oakwood Village President, Board of Trustees and immediate supervisor of any criminal drug statute conviction for a violation occurring no later than five days after conviction.
E. 
Take one of the following actions, within 30 days of receiving notice under Subsection D(2) of this section with respect to any personnel who is convicted:
(1) 
Take appropriate personnel action against such a person, up to and including termination; and/or
(2) 
Require such personnel to participate satisfactorily in a drug abuse assistance or rehabilitation program approved for such purposes by a federal, state or local health, law enforcement or other appropriate agency.
F. 
Making a good-faith effort to continue to maintain a drug-free workplace through implementation of Subsection A through E above.
G. 
Any personnel may be asked to take a drug or alcohol test at any time for any reason. Anyone involved in a major or personal injury motor vehicle crash while responding in their personal motor vehicle or any time driving a Village-owned motor vehicle will be required to take a drug screen and alcohol test immediately to comply with this policy.

Each member of the Village personnel shall be presented with a copy of the drug-free and alcohol-free workplace policy and sign a receipt acknowledging receipt of and agreement to the policy.
