The right-of-way to erect, construct, maintain and operate the necessary poles and wires above, through, upon and over the several streets, lanes and alleys in the Municipality, in the County of Centre and State of Pennsylvania, be, and the same is hereby granted to the West Penn Power Company, its successors and assigns, for the distribution and supply of light, heat and power, by electricity or other means, to the public and to the inhabitants of the Municipality, and that the consent of the Council to the entry by the said Company upon the said streets, lanes and alleys for the purposes aforesaid, and also to alter, inspect, change and repair its system, be and the same is hereby given to the said Company.

The said poles, within the limits of the said Municipality, shall not be less than 30 feet in height above the level of the street, lanes and alleys, unless by the express consent of the Public Works Committee{30}, and shall be straight and, with fixtures to be erected, shall be put up in a neat, safe and substantial manner and well-painted and kept painted and shall be located under the direction of Council or the Public Works Committee in such a manner as not to obstruct said streets, lanes and alleys or any gutter or drain in their ordinary or customary use, as established at the time of the erection of the poles or the laying of pipes and conduits.

In laying pipes or conduits in, upon or under any of the streets, lanes or alleys, the said Company shall place the same along or at one side of any street, lane or alley they may desire to occupy for such purpose and, in laying said pipes or conduits or in repairing the same, the said Company shall remove or cause to be removed all dirt, stone and rubbish and repair all damage occasioned to said streets, lanes or alleys or sidewalks by reason of the laying of said pipes of conduits or the erection of said poles.

The Municipality shall have the right to attach its fixtures to the poles of the West Penn Power Company and to place thereon the wires and equipment for the municipal fire alarm system, police signal system and traffic control system at points on said poles designated by said Company. Said Municipality shall indemnify and save harmless West Penn Power Company from any loss, cost, damage, claim or liability resulting from or caused by the occupation of said poles by the aforesaid systems or by reason of the operation or non-operation of the same.

Sections 101, 102 and 103 herein are hereby modified as follows: In all areas of the Municipality zoned residential, all electric lines, either overhead or underground, shall be located within easements provided for such purpose by the owner thereof along rear lot lines and not within the public street (etc.) rights-of-way.
